<br />Januarv 10, 2006 <br /> <br />At a Regular Meeting of the City Council on Tuesday, January 10, 2006 there <br />were present: <br /> <br />Mayor James W. Holley III, Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. <br />Heretick, Ray A. Smith, Sr., City Manager James B. Oliver, Jr., City Attorney G. Timothy <br />Oksman. <br /> <br />Reverend Frances Craig, opened the meeting with prayer, which was followed by <br />the Pledge of Allegiance to the Flag led by Girl Scout Troop #753. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to approve the minutes <br />of a Called Meeting on December 12, 2005, of a Called Meeting on December 13, 2005, <br />of a Regular Meeting on December 13, 2005, and of a Called meeting on January 4, <br />2006, and was adopted by a vote of 5-0. <br /> <br />06 - 17 - Presentation: <br /> <br />. Presentation of special lapel pins to newly appointed Board and Commission <br />members. <br /> <br />- Public Hearing - <br /> <br />06 - 18 - Public hearing on a use permit and street closure applications: <br /> <br />(a) UP-05-24 <br /> <br />CAVALIER MANOR NEIGHBORHOOD - Aziz Sair requests a use <br />permit to operate a gas station/convenience store/car wash at <br />3709, 3711 Victory Boulevard and 3706 Rapidan Street. Vision <br />Principle: A Robust and Prospering Economy. <br /> <br />1. Robert Barclay, 200 High Street, Suite 200, spoke in support of this item. <br /> <br />2. Joseph Wright, 1451 Welcome Road, spoke in support of this item. <br /> <br />Motion by Councilman Whitehurst, and seconded by Ms. Randall, to defer <br />consideration of UP-05-24 to the meeting of May 9, 2006 to allow Staff to conduct an <br />impact study. <br /> <br />Substitute motion by Mr. Smith, and seconded by Mr. Heretick, to defer <br />consideration of UP-05-24 to the meeting of January 24, 2006, and was adopted by the <br />following vote: <br /> <br />Ayes: Heretick, Randall, Smith <br />Nays: Whitehurst, Holley <br /> <br />(b) Z-05-37 <br /> <br />OLDE TOWNE SOUTH NEIGHBORHOOD - John Lee requests a <br />use permit to operate a restaurant at 425 County Street. Vision <br />Principle: A Robust and Prospering Economy. <br /> <br />1. Kevin Lee, 4169 Cheswick Lane, spoke in support of this item. <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to concur with the <br />recommendation of the Planning Commission that Z-05-37 be approved on first reading, <br />and was adopted by the following vote: <br /> <br />Ayes: Heretick, Randall, Smith, Whitehurst <br />Nays: Holley <br />
