<br />November 8. 2005 <br /> <br />2. That Joseph C. Woodell is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to operate body art studio <br />at 3212 and 3214 Victory Boulevard, Portsmouth, Virginia, and being more particularly <br />described as: <br /> <br />UP-05-29 <br /> <br />Beginning at a point on the north side of Victory Blvd <br />approximately 153 feet +/- from the intersection of Gust Lane <br />and Victory Blvd, thence in a north-easterly direction <br />approximately 160 feet +/- straight, to a point; thence in a <br />east-north-easterly direction approximately 67 feet +/- to a <br />point; thence in a south-easterly direction approximately 55 <br />feet +/- to a point; thence in a south-westerly direction <br />approximately 208 feet +/- to a point; thence in a north- <br />westerly direction approximately 120 feet +/- to the point of <br />beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Hours of operation shall be 10:00 a.m. to 1 :00 a.m., Monday through <br />Saturday, and 1 :00 p.m. to 9:00 p.m. on Sunday. <br /> <br />(b) The applicant shall comply with the submitted floor and site plans dated <br />received August 11, 2005, except as modified herein. A site plan review and approval <br />by the Engineering Department is required. <br /> <br />(c) A six-foot (6') solid wooden privacy fence shall be constructed from the <br />waste management dumpsters to the front building fagade along the eastern property <br />line. <br /> <br />(d) The existing chain link fence and vegetative barrier at the northern edge of <br />the property shall be maintained. <br /> <br />(e) A 10-foot Group 3 or Group 5 landscaping strip shall be established and <br />maintained along the Victory Boulevard corridor frontage. A landscaping plan shall be <br />reviewed and approved by the Department of Planning. <br /> <br />(f) Signage, as defined in Section 40-22 of the Zoning Ordinance, for the <br />parcel is limited to 120 square feet total to serve all uses. <br /> <br />(g) <br />Planning. <br /> <br />All signage shall be reviewed and approved by the Department of <br /> <br />(h) Any new construction of free-standing signage shall be of a monument <br />style and shall be reviewed and approved by the Department of Planning. <br /> <br />(i) One shared access with curb and gutter shall be established for both <br />tenants of the building. <br /> <br />(j) The parking area shall be repaved. Twelve (12) off-street parking spaces <br />are required for the entire site and shall be appropriately lined and delineated. <br /> <br />(k) The applicant shall maintain private waste management contracts for both <br />regular commercial waste disposal and bio-waste disposal as proposed and approved <br />by the Department of General Services. <br /> <br />(I) The owners and/or operators of the establishment shall not violate any <br />laws of the Commonwealth or ordinances of the City related to peace and good order, <br />nor suffer repeated or chronic violations by any of its patrons or customers. <br />
