<br />November 8. 2005 <br /> <br />If the Chief of Police, in his discretion, determines that there are sufficient <br />violations of this type to comprise a significant law enforcement problem, he shall so <br />notify the applicant in writing and shall provide a copy of such notice to the Director of <br />Planning. <br /> <br />If, within six (6) months of the date of such letter, the Director of Planning <br />determines that the offenses against the peace and good order are continuing, then he <br />may initiate proceedings for revocation of this permit. Provided, however, that if such <br />problems are of severity that the Chief of Police determines that there is a significant <br />risk to public safety or peace and good order of such proportions as to create a risk of <br />blight, the revocation proceedings may be initiated by the Director of Planning <br />regardless of the six (6) month requirement which is otherwise applicable. <br /> <br />(m) The body art studio shall be operated and maintained in accordance with <br />all required inspections by the City Fire Department, Public Health Department, and <br />Building Official and shall include annual inspections. <br /> <br />(n) The body art studio shall be operated in compliance with all applicable <br />codes, ordinances, and regulations of federal, state, and local governments, and all <br />required licenses and permits shall be obtained and remain in effect during the <br />operation of the body art studio. <br /> <br />(0) Taxes and fees associated with the property shall be paid when due. <br /> <br />4. Nusbaum Realty Company has made application on behalf of <br />Aquarius Properties, L.L.C., pursuant to Section 40-112 of the Code of the City of <br />Portsmouth, Virginia (1988), as amended, for the approval and granting of a group <br />housing use permit for 156 apartment units to be constructed at 2800-2816 Turnpike <br />Road and 102-138 Howard Street, Portsmouth, Virginia; and <br /> <br />WHEREAS, the subject property is furthermore described as: <br /> <br />GHP-05-03 <br /> <br />Parcel A: Beginning at a pin at the intersection of the northern right-of-way line <br />of Turnpike Road and the western right-of-way line of Howard Street and running <br />thence along Turnpike Road along a curve having a radius of 5,230.20' an arc distance <br />of 134,46' to a pin; thence turning and running N 33 degrees 24'26" W 919.88' to a pin; <br />thence turning and running N 41 degrees 21'03" E 160.32' to a point in the western <br />right-of-way line of Howard Street; thence turning and running S 33 degrees 30'00" E <br />944.19' to a pin; thence turning and running S 13 degrees 16'47" W 29.87' to a pin in <br />the northern right-of -way line of Turnpike Road, the point of beginning. <br />
