<br />November 8. 2005 <br /> <br />(h) The project provides parking, building access and pathways for persons <br />with disabilities in accordance with the requirements of the Americans with Disabilities <br />Act. <br /> <br />2. That a group housing use permit for the construction of 156 residential <br />apartment units 2800-2816 Turnpike Road and 102-138 Howard Street, Portsmouth, <br />Virginia, is hereby granted to the applicant subject to the following terms and conditions <br />that shall be observed by the applicant and any successor in interest: <br /> <br />(a) Building construction shall be in general compliance with the elevations <br />submitted and on file in the Office of Planning and Zoning. The Director of Planning <br />may approve minor modifications. <br /> <br />(b) Building materials shall be asphalt shingles, simulated vinyl shakes, vinyl <br />siding, and brick veneer, as detailed in the Application for Group Housing Permit and <br />illustrated on the elevations. <br /> <br />(c) Site development shall be in general compliance with the Conceptual Site <br />Layout and Landscaping Plan of Mid- Towne Apartments dated 07/22/05. The Director <br />of Planning may approve minor modifications. <br /> <br />(d) A clubhouse and pool amenity shall be constructed in accordance with the <br />Conceptual Site Layout and Landscaping Plan of Mid-Towne Apartments dated <br />07/22/05 and in accordance with the photos submitted and on file in the Office of <br />Planning and Zoning. <br /> <br />(e) A site plan shall be submitted and approved by the Department of <br />Engineering before construction. <br /> <br />(f) The developer shall be responsible for costs associated with utility <br />upgrades deemed necessary by the Director of Public Utilities, including but not limited <br />to water, sewer, and/or stormwater facilities for the community. <br /> <br />(g) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments and shall obtain and maintain In <br />effect all necessary licenses and permits. <br /> <br />(h) All taxes owed on or in connection with the subject property shall be paid <br />in a timely manner. <br /> <br />3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- Other Unfinished Business <br /> <br />05 - 412 - Adoption of an ordinance amending Chapter 9 of the City Code to increase <br />fees for grave opening and closing, and replacing the perpetual care sections with a <br />burial permit fee section. (Electronic Roll Call) <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Psi mas, to defer consideration <br />of item 05-412 to the meeting of November 22, 2005, and was adopted by unanimous <br />vote. <br />
