September 27, 2005 Motion by Mr. Smith, and seconded by Mr. Heretick, to concur with the recommendation of the Planning Commission that Z-05-13 be approved on first reading and was adopted a vote of 4-3 (Randall, Whitehurst, Holley). (a) CA-05-02 CITYWIDE - The City of Portsmouth requests a code amendment to Section 40-52.1 (b) Historic Limited Office of the Zoning Ordinance to allow Limited Service Social Establishments. Deferred from the July 26, 2005 City Council Meeting. Vision Principle: A Robust and Prospering Economy. Motion by Mr. Whitehurst, and seconded by Ms. Randall, to refer Item CA-05-02 back to the Planning Commission and was adopted by a vote of 6-1 (Psimas). - Speakers Forum - 05 - 436 Public Comment (Agenda/Non-Agenda). 1. Lynn Breckridge, 448 Green Street, informed Council of a notice she received from the Department of Planning and Inspections prohibiting the display of a directional sign and wanted to clarification on the procedure with regards to the displaying of signs. 2. Cathy Revell, 422 Crawford Street, voiced her frustrations with delays regarding her use permit application and lack of understanding for the application process. 3. Mark Geduldig-Yatrofsky, 363 Middle Street, wanted to give his suggestions on how the Ntelos Pavilion can be successful. - Unfinished Business - Consent Aqenda: 05 - 408 - Use permit and rezoning applications: Motion by Mr. Whitehurst, and seconded by Ms. Psi mas, to adopt the following resolutions and ordinance, approved on first reading at the September 13, 2005 meeting, and was adopted by the following vote: 05 - 408(a): "RESOLUTION GRANTING A USE PERMIT TO OPERATE AN EATING ESTABLISHMENT AT 101 HIGH STREET. WHEREAS, Jeffrey Logan, on behalf of David and Elizabeth Cartier, has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate an eating establishment at 101 High Street; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended granting the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood;
