<br />September 27, 2005 <br /> <br />Motion by Mr. Smith, and seconded by Mr. Heretick, to concur with the <br />recommendation of the Planning Commission that Z-05-13 be approved on first reading <br />and was adopted a vote of 4-3 (Randall, Whitehurst, Holley). <br /> <br />(a) CA-05-02 <br /> <br />CITYWIDE - The City of Portsmouth requests a code amendment <br />to Section 40-52.1 (b) Historic Limited Office of the Zoning <br />Ordinance to allow Limited Service Social Establishments. <br />Deferred from the July 26, 2005 City Council Meeting. Vision <br />Principle: A Robust and Prospering Economy. <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to refer Item CA-05-02 <br />back to the Planning Commission and was adopted by a vote of 6-1 (Psimas). <br /> <br />- Speakers Forum - <br /> <br />05 - 436 <br /> <br />Public Comment (Agenda/Non-Agenda). <br /> <br />1. Lynn Breckridge, 448 Green Street, informed Council of a notice she received from <br />the Department of Planning and Inspections prohibiting the display of a directional <br />sign and wanted to clarification on the procedure with regards to the displaying of <br />signs. <br /> <br />2. Cathy Revell, 422 Crawford Street, voiced her frustrations with delays regarding her <br />use permit application and lack of understanding for the application process. <br /> <br />3. Mark Geduldig-Yatrofsky, 363 Middle Street, wanted to give his suggestions on how <br />the Ntelos Pavilion can be successful. <br /> <br />- Unfinished Business - <br /> <br />Consent Aqenda: <br /> <br />05 - 408 - Use permit and rezoning applications: <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Psi mas, to adopt the following <br />resolutions and ordinance, approved on first reading at the September 13, 2005 <br />meeting, and was adopted by the following vote: <br /> <br />05 - 408(a): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO OPERATE AN EATING <br />ESTABLISHMENT AT 101 HIGH STREET. <br /> <br />WHEREAS, Jeffrey Logan, on behalf of David and Elizabeth Cartier, has made <br />application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia <br />(1988) for the granting of a use permit to operate an eating establishment at 101 High <br />Street; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended granting the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br />
