<br />September 13. 2005 <br /> <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it hereby approves and adopts the Flood Management Plan as prepared by <br />the Council's Task Force. <br /> <br />BE IT FURTHER RESOLVED that the City Manager is authorized and directed <br />to take such additional measures as may be required to continue the City's membership <br />in the National Flood Insurance Program's Community Rating System Program." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />05 - 417 - Adoption of a resolution authorizing the City Manager to execute a Deed <br />and any other required documents necessary to release the portion of an easement <br />reserved on lot number 264 on the subdivision plat number 9 of Highland-Biltmore <br />upon its vacation and closure, so that the owner can construct an addition to his <br />existing residence on this lot. Vision Principle: Neighborhood and Community <br />Transformation. <br /> <br />Background: <br />. Mr. Joseph E. Byrd, the owner of a lot in the Highland-Biltmore subdivision, <br />desires to construct an addition to his existing residence on this lot. <br />. The City has a ten-foot wide utility easement on this property that is in conflict <br />with the proposed addition. <br />. At the request of Mr. Byrd, Public Utilities investigated the area within the <br />easement to determine the existence and location of utilities. <br />. It has been determined that no utilities exist within this portion of easement area <br />and there are no proposed plans to install utilities within this portion of the easement <br />area. Therefore, there is no further need for this portion of the easement. <br /> <br />Discussion: <br />. Financial Impact: There is no financial impact on the City. <br /> <br />Staff Recommends: <br />Adoption of a resolution authorizing the City Manager to execute a Deed and any other <br />required documents necessary to release the portion of an easement reserved on lot <br />number 264 on the subdivision plat number 9 of Highland-Biltmore upon its vacation <br />and closure, so that the owner can construct an addition to his existing residence on this <br />lot. Vision Principle: Neighborhood and Community Transformation. <br /> <br />Next Steps following City Council Action: <br />. The City Manager will execute the Deed of Release and any other required <br />documents on behalf of the City to complete the release of this portion of the easement. <br />. The Office of the City Attorney will see to the preparation of appropriate <br />documents to be presented to the City Manager for his execution releasing this <br />reserved portion of the easement. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF <br />RELEASE FROM THE CITY OF PORTSMOUTH TO VACATE A PORTION OF A <br />CERTAIN 10-FOOT UTILITY EASEMENT AS SHOWN ON LOT NUMBER 264 ON <br />THE SUBDIVISION PLAT OF HIGHLAND-BILTMORE, PLAT NUMBER 9. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the City Manager be, and he hereby is, authorized to execute a deed of release from <br />the City of Portsmouth to vacate a portion of a certain 10-foot utility easement as shown <br />on Lot Number 264 on the subdivision plat of Highland-Biltmore, Plat Number 9, it being <br />the western portion of the aforementioned utility easement and more particularly <br />described as shown on the attached Exhibit." <br /> <br />Ayes: Heretick, Moody, Randall, Psimas, Smith, Whitehurst, Holley <br />Nays: None <br />
