(b) UP-05-16 AUQust 9. 2005 SIMONSDALE NEIGHBORHOOD - Robert Barclay, agent for Lonnie Parker, requests a use permit at 300 Cherokee Road to allow 22 children at the existing day care. Motion by Mr. Whitehurst, and seconded by Mr. Moody, to concur with the recommendation of the Planning Commission that UP-05-16 be approved on first reading, and was adopted by unanimous vote. (c) UP-05-19 HIGHLANDS NEIGHBORHOOD - Clark-Nexson, on behalf of Sprintcom Inc., requests a use permit to co-locate and extend an existing cellular tower located on a portion of 44 Alabama Avenue. Vision Principle: Community and Neighborhood Transformation. The Comprehensive Plan recommends mixed- use development. Motion by Ms. Randall, and seconded by Mr. Whitehurst, to concur with the recommendation of the Planning Commission that UP-05-19 be approved on first reading, and was adopted by unanimous vote. (d) S-05-04 PRENTIS PARK/BRIGHTON NEIGHBORHOOD - Ordinance granting the request of the City of Portsmouth, 2-E, LLC, and Spartacus, LLC a street closure for an unnamed street located off Frederick Boulevard. Vision Principle: A Robust and Prospering Economy. The Comprehensive Plan recommends commercial development. Motion by Mr. Moody, and seconded by Ms. Psi mas, to adopt the following ordinance, and was adopted by the following vote: "AN ORDINANCE CLOSING AND VACATING AN UNNAMED STREET LOCATED AT THE EASTERN RIGHT OF WAY LINE OF FREDERICK BOULEVARD NEAR THE INTERSECTION WITH BAGLEY STREET." Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None 05-337 - Unfinished Business - Adoption of an ordinance to eliminate the current criminal prohibition against tattooing and to establish a procedure for the issuance of health permits by the Health Department to body art establishments.
