<br />July 26. 2005 <br /> <br />(g) The applicant shall not violate any laws of the Commonwealth or <br />ordinances of the City related to peace and good order, nor suffer repeated chronic <br />violations by any of its patrons or customers. If the Chief of Police, in his discretion, <br />determines that there are sufficient violations of this type to comprise a significant law <br />enforcement problem, then he shall so notify the applicant in writing and shall offer to <br />meet to provide advice on how to lessen and avoid repeated offenses against peace <br />and good order. A copy of this letter shall be provided to the Director of Planning and <br />Zoning. If, within six months of the date of this letter, said Director, in his discretion, <br />determines that offences against peace and good order are continuing, then he may <br />initiate proceedings for the revocation of this permit. Provided, however, that if <br />problems of peace and good order are of such severity that the Chief of Police <br />determines that there is a significant risk to public safety or peace and good order or <br />such properties as to create a risk of blight, then revocation proceedings may be <br />initiated by the Director without regard to the six month requirement which is otherwise <br />required. <br /> <br />(h) All taxes in connection with the proposed use shall be paid when due. <br /> <br />4. A <br />$15,294 City cash match is required. Vision Principle: Neighborhood and Community <br />Transformation. <br /> <br />Background: <br />. The program's focus will be directed towards aggressively utilizing enhanced state <br />laws for possession of illegal firearms to prosecute offenders, along with the current <br />bail procedures to keep offenders in jail during the prosecution phase. <br />. This program supports a full-time prosecutor who is experienced in vigorous <br />prosecution, program management and community awareness campaigns. <br /> <br />Discussion: <br />. Financial Impact: $45,885 in Federal funds has been awarded. A $15,294 cash <br />match will be provided by the City of Portsmouth. <br /> <br />Staff Recommends: <br />Adoption of an ordinance to appropriate $61,179 from the Byrne Memorial Grant to the <br />Commonwealth's Attorney Office for the Project Exile Program. A $15,294 cash <br />match is required. Vision Principle: Neighborhood and Community Transformation. <br /> <br />Next Steps Following Council Action: <br />. The Commonwealth's Attorney will maintain oversight and management <br />responsibility of this program. <br /> <br />Motion by Mr. Heretick, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE ACCEPTING A GRANT IN THE AMOUNT OF $45,885 FROM THE <br />BYRNE MEMORIAL GRANT PROGRAM AND APPROPRIATING $61,179 IN THE <br />FY 2005-2006 GRANTS FUND FOR THE PROJECT EXILE PROGRAM." <br /> <br />Ayes: Heretick, Moody, Randall, Smith, Whitehurst, Holley <br />Nays: None <br />
