Vision Principle: Bold New Directions.

Background:
. Verizon currently provides telecommunication service to Portsmouth's Lake Kilby
Water Treatment Plant in Suffolk, VA.
. The City desires to relocate the Verizon service so that it will not interfere with
planned future construction (replacement of the Lake Kilby/Lake Meade Raw Water
Pumping Station) at the Lake Kilby Plant.
. Relocation of the underground service requires the City to grant Verizon a 10-foot
easement across a corner of the Lake Kilby Plant's property fronting West Washington
Street and Maury Place in Suffolk.

Discussion:
. The Office of the City Attorney has reviewed the easement agreement, and the
Director of Public UtilitieslWorks recommends execution of the Deed of Easement with
Verizon.
. Financial Impact: In addition to the granting of an easement, the relocation of
Lake Kilby telecommunications service will cost $8,278.00. Funding will be from the
adopted Public Utilities FY'06 Operating Budget.

Recommended Action:
Adoption of a Resolution authorizing the City Manager to execute a Deed of Easement
with Verizon to furnish telecommunication service to Portsmouth's Lake Kilby Water
Plant in Suffolk, Virginia. Vision Principal: Bo/d New Directions.

Next Steps following City Council Action:
. The City Manager will execute the Deed of Easement on behalf of the City.
. The Office of the City Attorney will record the Deed of Easement in Suffolk, VA
and deliver it to Verizon.
. The Department of Public UtilitieslWorks will execute a Purchase Order with
Verizon in the amount of $8,278.00 and will oversee the installation of the new
telecommunication service.

Motion by Ms. Randall, and seconded by Mr. Heretick, to adopt the following
resolution, and was adopted by the following vote:

"A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE DEED OF
EASEMENT GRANTING VERIZON AN EASEMENT TO PROVIDE RELOCATED
TELECOMMUNICATION SERVICE AT PORTSMOUTH'S LAKE KILBY WATER
TREATMENT PLANT LOCATED IN THE CITY OF SUFFOLK.

BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the
City Manager be, and he hereby is, authorized to execute a deed of easement to
Verizon to provide relocated telecommunication service at Portsmouth's Lake Kilby
Water Treatment Plant located in the City of Suffolk, as he deems to be in the best
interest of the City at such time as he may deem appropriate.

BE IT FURTHER RESOLVED that the City Manager is hereby authorized to
execute such deeds, plats and other documents necessary to effect the conveyance of
an easement herein authorized between the City and Verizon as may be required, and
to require such deeds and documents to contain such other provisions as he may deem
appropriate and in the best interest of the City of Portsmouth."

Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley
Nays: None
