<br />May 24.2005 <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Psi mas, to concur with the <br />recommendation of Planning Commission that UP-05-1 0 be approved on first reading, <br />and was adopted by a unanimous vote. <br /> <br />(d) SNC-05-01 <br /> <br />DOWNTOWN NEIGHBORHOOD - Ordinance granting the <br />request of the City of Portsmouth a street name change of the <br />existing Harbor Street to Bill Deal Street. The existing street is <br />located between Water Street and Harbor Court. Vision <br />Principle: Neighborhood and Community Transformation. The <br />Comprehensive Plan recommends mixed-use downtown. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Randall, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"AN ORDINANCE TO CHANGE THE NAME OF HARBOR STREET TO BILL DEAL <br />STREET BETWEEN WATER STREET AND HARBOR COURT." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />- Unfinished Business - <br /> <br />05 - 222 - Group housing, use permit and rezoning: <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Heretick, to adopt the following <br />resolution, approved on first reading at the May 10, 2005 meeting, and was adopted <br />by the following vote: <br /> <br />05-222(a): <br /> <br />"RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING USE PERMIT <br />(GHP-05-02) TO JOSEPH AND ELAINE CAPLAN FOR THREE APARTMENT <br />UNITS AT 630 HIGH STREET. <br /> <br />WHEREAS, Joseph and Elaine Caplan, pursuant to Section 40-112 of the <br />Code of the City of Portsmouth, Virginia (1988), as amended, have applied for the <br />approval and granting of a group housing use permit for three apartment units to be <br />constructed at 630 High Street, Portsmouth, Virginia; and <br /> <br />WHEREAS, the subject property is furthermore described as: <br /> <br />GHP-05-02 <br /> <br />Beginning approximately 90 feet east of the intersection of Green <br />Street and High Street along the northern right-of-way line of High <br />Street thence east approximately 25 feet along the north <br />right-of-way line of High Street to a point; thence north <br />approximately 153 feet to a point, thence west approximately <br />69 feet to a point, thence south 68 feet to a point; thence east <br />approximately 44 feet to a point; thence south approximately <br />84 feet to the point of beginning. <br /> <br />and <br /> <br />WHEREAS, the Planning Commission has reviewed such application and site <br />plan submitted therewith and has recommended conditional approval of said <br />application; and <br /> <br />WHEREAS, the applicants have been informed that approval of the group <br />housing project pursuant to Section 40-116 only grants an exemption from certain <br />requirements for residences as stated in said section and does not constitute a waiver <br />of any other requirement embodied in the Subdivision Ordinance, Zoning Ordinance, <br />Code of the City of Portsmouth, Virginia, or any other applicable local, state or federal <br />law or regulation; and <br />
