<br />March 22. 2005 <br /> <br />(h) All taxes in connection with the property and the operation shall be paid <br />when due. <br /> <br />(i) The applicant and any successor in interest shall not violate any laws of <br />the Commonwealth or ordinances of the City related to peace and good order, nor <br />suffer repeated or chronic violations by any of its patrons or customers. If the Chief of <br />Police, in his discretion, determines that there are sufficient violations of this type to <br />comprise a significant law enforcement problem, then he shall so notify the applicant <br />or its successor in writing and shall offer to meet to provide advice on how to lessen <br />and avoid repeated offenses against peace and good order. A copy of this letter shal <br />I be provided to the Director of Planning and Inspections. <br /> <br />If, within six months of the due date of this letter, said Director, in his <br />discretion, determines that offenses against peace and good order are continuing, <br />then he may initiate proceedings for the revocation of this use permit. Provided, <br />however, that if problems of peace and good order are of such severity that the Chief <br />of Police determines that there is a significant risk to public safety or peace and good <br />order of such proportions as to create a risk of blight, then revocation proceedings <br />may be initiated by the Director without regard to the six-month requirement which is <br />otherwise applicable. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br />Abstained: Heretick (Abstained because the applicant is a client) <br /> <br />- Other Unfinished Business - <br /> <br />04 - 360 - Use permit: <br /> <br />(a) UP-04-11 <br /> <br />PRENTIS PARK/BRIGHTON NEIGHBORHOOD - Community <br />Chapel Methodist Church requests a use permit to construct and <br />operate a new worship facility at 1656 Portsmouth Boulevard. <br />Deferred from the November 23, 2004 City Council meeting. <br />Vision Principle: Neighborhood and Community Transformation. <br /> <br />1. Reggie Allen, 1421 Wilcox Avenue, spoke in opposition to this item. <br /> <br />2. Reverend Grace Lang, 1390 Watson Street, spoke in support of this item. <br /> <br />3. Burnett Cobbs, 2925 Middle Avenue, spoke in support of this item. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Smith, to concur with the <br />recommendation of the Planning Commission that UP-04-11 be denied, and was <br />adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />05 - 124 - Adoption of an ordinance to accept $2,709 from the Bureau of Justice <br />Assistance and to appropriate this same amount in the Grant Fund for the Bulletproof <br />Vest Program. <br /> <br />These funds will be used to reimburse a portion of the costs expended for the <br />purchase of bulletproof vests for the Police Department.
