<br />March 22. 2005 <br /> <br />1. That regarding Amendment No. 36, it is hereby found: <br /> <br />(a) That the objectives of the Crawford Urban Renewal Project, <br />Portsmouth, Virginia, can be better achieved by the adoption of said Amendment to the <br />Plan. <br /> <br />(b) That Amendment No. 36 meets the requirements of a plan for an <br />urban renewal project pursuant to Chapter 1 of Title 36 of the Code of Virginia, 1950, as <br />amended. <br /> <br />2. That Amendment No. 36, having been duly reviewed and considered, is <br />hereby approved and adopted, and the City Clerk is hereby directed to file a copy of <br />said Amendment with the minutes of this meeting." <br /> <br />05-129(B): <br /> <br />"A RESOLUTION APPROVING THE 2006 ACTION PLAN OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, AND AUTHORIZING THE CITY MANAGER TO FILE <br />DOCUMENTS REQUIRED TO OBTAIN THE CITY'S 2006 COMMUNITY PLANNING <br />AND DEVELOPMENT GRANT ENTITLEMENTS. <br /> <br />WHEREAS, pursuant to the Housing and Community Development Act of 1974, <br />as amended, and the Cranston - Gonzalez National Affordable Housing Act of 1992, as <br />amended, ("Acts"), financial assistance is provided to enable localities to provide decent <br />housing, establish and maintain suitable living environments, and expand economic <br />opportunities for low to moderate income residents; and <br /> <br />WHEREAS, each of the three community planning and development programs <br />(Community Development Block Grant, HOME, and the Emergency Shelter Grant) shall <br />be operated on a single consolidated program year ("Action Plan"); and <br /> <br />WHEREAS, the required public hearing has been held and the City Council has <br />reviewed the proposed 2006 Action Plan's Statement of Objectives and Use of Funds; <br />and <br /> <br />WHEREAS, it is necessary that this Council take official action regarding the <br />2006 Action Plan to comply with the regulations of the aforementioned Acts; and <br /> <br />WHEREAS, this Council is aware of the federal regulations governing the <br />undertaking and carrying out of activities under the Consolidated Plan Program; and <br /> <br />WHEREAS, this Council recognizes its responsibility to direct that safeguards be <br />established to protect employees from using their positions for a purpose that gives the <br />appearance of being motivated by a desire for private gain for themselves or others, <br />particularly those with whom they have family, business or other ties; and <br /> <br />WHEREAS, this Council has found that the use of Funds for the 2006 Action <br />Plan is appropriate to meet the needs of the City and, therefore, are acceptable. <br /> <br />NOW THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia, that the 2006 Action Plan's Proposed Statement of Objectives and use of <br />Funds having been reviewed and considered, said plans be and hereby are approved <br />as final in all respects, and the City Manager is hereby authorized to file the Final <br />Statement of Objectives and use of Funds and any additional information as may be <br />required with the Department of Housing and Urban Development in order to obtain <br />funding for the Program. <br /> <br />BE IT FURTHER RESOLVED that the City Manager is designated as the <br />certifying officer and authorized representative of the City of Portsmouth and shall <br />provide assurances as required of the locality by the Acts for the approval of the <br />Program." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br />
