<br />February 22. 2005 <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That a use permit is hereby granted pursuant to Section 40-43.1 of the <br />Code of the City of Portsmouth, Virginia (1988) for the operation of a convenience <br />store with gas pumps at 2886 Airline Boulevard, and being more particularly described <br />as: <br /> <br />UP-05-01 <br /> <br />Beginning at a point at the northeast intersection of <br />City Park Avenue and Airline Boulevard; thence, In a <br />northwesterly direction 100':t to a point; thence, In a <br />northeasterly direction 150':t to a point; thence, In a <br />southeasterly direction 142':t to a point; thence, In a <br />southwesterly direction 130':t to the point of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br />(a) Hours of operation shall be limited to between 6:00 a.m. and midnight <br /> <br />daily. <br /> <br />(b) No beer in 40-ounce containers or larger may be sold at the facility. <br /> <br />(c) The applicant shall provide two parking spaces, as required under City <br />Code section 40-43.1-2 for convenience stores with gas sales (S.1. C. 5411). <br /> <br />(d) The existing parking lot shall comply with City Code section 40-71.2 <br />pertaining to parking lot screening and landscaping requirements. <br /> <br />(e) All employee parking shall take place on the sides and rear of the <br />building. Parking in front of the building shall be reserved for customers. <br /> <br />(f) The applicant or other developer of the property shall be responsible for <br />the design, permit application, fee payment, and construction of any reconditioning or <br />upgrading of water and sewer connections for the existing structure. <br /> <br />(g) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />required licenses and permits. <br /> <br />(h) All taxes in connection with the subject property and the proposed use <br />shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />05 - 73 - Adoption of an ordinance to amend the Public Utilities Capital Improvements <br />Fund for the preliminary engineering and design of the water and sewer improvements <br />to the Prentis Park Neighborhood. <br /> <br />This ordinance provides the required match for a USEPA grant needed to <br />proceed with water and sewer improvements in the Prentis Park neighborhood. <br />Vision Principle: Neighborhood and Community Transformation. <br />
