December 14, 2004 <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />04 - 482 - Adoption of an ordinance amending the City's Classification and Pay Plan to <br />comply with revised Department of Labor (DEL) Fair Labor Standards Act (FLSA) <br />regulations. <br /> <br />Seven positions required a change in status from exempt to non-exempt related <br />to the hours calculated for the purpose of overtime/compensatory time during a <br />workweek. <br /> <br />Recommended Action: <br /> <br />· Adoption of an ordinance amending the City's Classification and Pay Plan to comply <br />with revised Department of Labor (DEL) Fair Labor Standards Act (FLSA) regulations. <br /> <br />Summary: <br /> <br />· This action is needed to bring the Code of the City of Portsmouth into compliance <br />with federal law. <br /> <br />Purpose and Need: <br /> <br />· Amendments to the FLSA regulations have changed the FLSA classifications of <br />certain City positions from exempt to non-exempt. <br /> <br />· Non-exempt employees are entitled to overtime/compensatory time for hours worked <br />in excess of a regular 40-hour workweek. <br /> <br />· Positions listed in the Classification and Pay Plan were reviewed for the appropriate <br />FLSA classification. <br /> <br />· Amendment of the Classification and Pay Plan is needed to bring the Plan into <br />compliance with federal law. <br /> <br />Financial Impact: <br /> <br />· All seven (7) positions requiring FLSA changes have changed from exempt to <br />non-exempt. While the actual dollar amount of the financial impact cannot be <br />determined at this time, the impact will be from the possibility of overtime/compensatory <br />time pay to these non-exempt employees in the event that they are required to work <br />over 40 hours in a given workweek. <br /> <br /> Motion by Mr. Heretick, and seconded by Ms. Randall, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE AMENDING THE 2004-2005 CLASSIFICATION AND PAY PLAN TO <br />RECLASSIFY CERTAIN EMPLOYEES AS NON-EXEMPT." <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />04 - 483 - Adoption of a resolution authorizing the City Manager to execute a deed of <br />conveyance to the Portsmouth Redevelopment and Housing Authority (PRHA) for a <br />parcel of property located on the western side of Riverview Avenue. <br /> <br />Conveyance of this property will facilitate the continued implementation of the <br />Park View Revitalization Strategy. <br /> <br />Recommended Action: <br /> <br />· Adoption of a resolution authorizing the City Manager to execute a deed of <br />conveyance to the Portsmouth Redevelopment and Housing Authority (PRHA) for a <br />parcel of property located on the western side of Riverview Avenue. <br /> <br /> <br />
