December 14, 2004 <br /> <br /> At a Regular Meeting of the City Council on Tuesday, December 14, 2004, <br />there were present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., <br />Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. <br /> <br /> Reverend Dr. W. Alan Mugler, Pastor, Cradock Presbyterian Church, opened the <br />meeting with prayer, which was followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Ms. Randall, to approve the minutes <br />of a Called Meeting on November 23, 2004, and a Regular Meeting on November 23, <br />2004, and was adopted by unanimous vote. <br /> <br />04 - 475 - Presentation: <br /> <br />· Presentation of special lapel pins to newly appointed Board and Commission <br /> members. <br /> <br />- Public Hearing - <br /> <br />04 - 476 - Public hearing on rezoning, code amendment and street closure applications: <br /> <br />(a) Z-04-07 <br /> <br />MIDTOWN AREA - The Economic Development Authority requests <br />the rezoning of property at 2900 Turnpike Road from residential, <br />RM-60 to commercial, C-2-K (conditional) to allow commercial <br />development on the site. <br /> <br /> Motion by Mr. Moody, and seconded by Ms. Randall, to concur with the <br />recommendation of the Planning Commission that Z-04-07 be approved on first reading, <br />and was adopted by unanimous vote. <br /> <br />(b) CA-04-02 <br /> <br />CITYVVlDE - The City of Portsmouth requests to amend Section 9.1 <br />of the Portsmouth City Code (Chesapeake Bay Preservation Area <br />Overlay Ordinance) to address the two (2) recommendations <br />established by the Department of Conservation and Recreation's <br />Division of Chesapeake Bay Local Assistance (DCBLA) Board. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to concur with the <br />recommendation of the Planning Commission that CA-04-02 be approved on first <br />reading, and was adopted by unanimous vote. <br /> <br />(c) S-04-06 <br /> <br />PARKVlEW NEIGHBORHOOD - Ordinance granting the request of <br />the City of Portsmouth for the closure of a portion of Riverview <br />Avenue adjacent to the Navy Medical Center. The purpose of the <br />street closure is to redevelop the property for open space. <br /> <br /> Motion by Mr. Moody, and seconded by Ms. Randall, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE CLOSING AND VACATING A PORTION OF RIVERVIEW AVENUE." <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br /> <br />
