December 14, 2004 At a Regular Meeting of the City Council on Tuesday, December 14, 2004, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. Reverend Dr. W. Alan Mugler, Pastor, Cradock Presbyterian Church, opened the meeting with prayer, which was followed by the Pledge of Allegiance to the Flag. Mayor Holley called the meeting to order and welcomed all in attendance. Motion by Mr. Whitehurst, and seconded by Ms. Randall, to approve the minutes of a Called Meeting on November 23, 2004, and a Regular Meeting on November 23, 2004, and was adopted by unanimous vote. 04 - 475 - Presentation: · Presentation of special lapel pins to newly appointed Board and Commission members. - Public Hearing - 04 - 476 - Public hearing on rezoning, code amendment and street closure applications: (a) Z-04-07 MIDTOWN AREA - The Economic Development Authority requests the rezoning of property at 2900 Turnpike Road from residential, RM-60 to commercial, C-2-K (conditional) to allow commercial development on the site. Motion by Mr. Moody, and seconded by Ms. Randall, to concur with the recommendation of the Planning Commission that Z-04-07 be approved on first reading, and was adopted by unanimous vote. (b) CA-04-02 CITYVVlDE - The City of Portsmouth requests to amend Section 9.1 of the Portsmouth City Code (Chesapeake Bay Preservation Area Overlay Ordinance) to address the two (2) recommendations established by the Department of Conservation and Recreation's Division of Chesapeake Bay Local Assistance (DCBLA) Board. Motion by Mr. Whitehurst, and seconded by Mr. Moody, to concur with the recommendation of the Planning Commission that CA-04-02 be approved on first reading, and was adopted by unanimous vote. (c) S-04-06 PARKVlEW NEIGHBORHOOD - Ordinance granting the request of the City of Portsmouth for the closure of a portion of Riverview Avenue adjacent to the Navy Medical Center. The purpose of the street closure is to redevelop the property for open space. Motion by Mr. Moody, and seconded by Ms. Randall, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE CLOSING AND VACATING A PORTION OF RIVERVIEW AVENUE." Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley Nays: None
