<br /> At a Regular Meeting of the City Council on Tuesday, November 9, 2004,
<br /> there were present:
<br />
<br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst,
<br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr.,
<br />Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman.
<br />
<br /> Reverend Thornton M. Frye, Pastor, Biltmore Baptist Church, opened the
<br />meeting with prayer, which was followed by the Pledge of Allegiance to the Flag.
<br />
<br /> Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to approve the minutes
<br />of a Called Meeting on October 2(~, 2004, and a Regular Meeting on October 2(~, 2004,
<br />and was adopted by unanimous vote.

<br />· Proclamation presented to Councilman Whitehurst for "Prematurity Awareness Day/'

<br /> - Public Hearing -
<br />
<br />04 - 432 - Public hearing on use permit applications:
<br />
<br />(a) UP-04-20 AIRLINE COMMERCIAL DISTRICT - Soon Kim requests a use
<br /> permit for an entertainment establishment at 107 Chowan Drive.
<br />
<br />1. Kathleen Carlson, 11(~ Chowan Drive, spoke on this item and was undecided on the
<br /> application.
<br />
<br />2. Colette Boes, 240 Cherokee Road, spoke in opposition to this item.
<br />
<br />3. Richard Kim, 107 Chowan Drive, spoke in support of this item.
<br />
<br />4. Mark Geduldig-Yatrofsky, 3(~3 Middle Street, spoke in opposition to this item.
<br />
<br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the
<br />recommendation of the Planning Commission that UP-04-20 be denied on first and final
<br />reading, and was adopted by the following vote:

<br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley
<br />Nays: None
<br />
<br />(b) UP-04-21 DOWNTOWN NEIGHBORHOOD Vicki Parker requests a use
<br /> permit to establish an entertainment establishment and a parking
<br /> exception at 455 Court Street.
<br />
<br />1. Mark Geduldig-Yatrofsky, 3(~3 Middle Street, spoke in opposition to this item.
<br />
<br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to concur with the
<br />recommendation of the Planning Commission that UP-04-21 be approved on first
<br />reading, and was adopted by unanimous vote.

<br /> - City Manager's Report -
<br />
<br />04 - 433 - Adoption of an ordinance to accept $3,488 in additional grant funds and
<br />appropriate this same amount in the Grants Fund for the Portsmouth Ready to Read
<br />Coalition to support training of early care providers to enhance the reading readiness of
<br />young children.
<br />
<br /> The grantor has provided this additional funding for the Early Learning
<br /> Opportunities Grant administered by the Department of Community Relations
<br /> and Leisure Service.
