September 14, 2004 At a Regular Meeting of the City Council on Tuesday, September 14, 2004, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. Vice Mayor William E. Moody, Jr. opened the meeting with prayer, which was followed by the Pledge of Allegiance to the Flag, presented by Boy Scout Troop #233. Mayor Holley called the meeting to order and welcomed all in attendance. Motion by Mr. Whitehurst, and seconded by Mr. Moody, to approve the minutes of a Called Meeting on August 24, 2004, and a Regular Meeting on August 24, 2004, and was adopted by unanimous vote. 04 - 329 - Presentations: · Presentation by Ken Woolard, Chairman of the Museum and Fine Arts Commission, to the City of Portsmouth. · Presentation to the City of Portsmouth by R. J. Nutter and Grif Lynch, on behalf of Maersk Sealand. · Proclamation presented to Elaine Kubiszer for "Constitution Week." · Introduction of visiting Belgium Firefighters by Deputy Fire Chief Newell Whitehead. - Public Hearing - 04 - 330 - Public hearing on rezoning and street closure applications: (a) Z-04-04 DOWNTOWN NEIGHBORHOOD - Shirley Clayton requests to rezone property at 705 Washington Street from Downtown D-1-M mixed use (conditional) to Downtown D-1-M mixed use. Motion by Mr. Moody, and seconded by Ms. Randall, to concur with the recommendation of the Planning Commission that Z-04-04 be approved on first reading, and was adopted by unanimous vote. (b) S-04-01 PORT CENTRE COMMERCE PARK - Ordinance granting the request of the Economic Development Authority and Portsmouth Redevelopment and Housing Authority the closure of a portion of Sixth Street between the northern and southern boundaries of Nelson Street. The Comprehensive Plan encourages the closure of unneeded rights-of-way which serve no traffic or land use functions. Motion by Mr. Whitehurst, and seconded by Mr. Heretick, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE CLOSING AND VACATING A PORTION OF SIXTH STREET BETWEEN THE NORTHERN AND SOUTHERN RIGHT OF WAY LINES OF NELSON STREET." Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley Nays: None (c) S-04-05 HIGHLANDS NEIGHBORHOOD - Ordinance granting the request of the City of Portsmouth and Mr. Russell Oliveira the street closure of part of Gwaltney Court for the purpose of straightening the alignment of the street.
