September 14, 2004 <br /> <br /> At a Regular Meeting of the City Council on Tuesday, September 14, 2004, <br />there were present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., <br />Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. <br /> <br /> Vice Mayor William E. Moody, Jr. opened the meeting with prayer, which was <br />followed by the Pledge of Allegiance to the Flag, presented by Boy Scout Troop #233. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to approve the minutes <br />of a Called Meeting on August 24, 2004, and a Regular Meeting on August 24, 2004, <br />and was adopted by unanimous vote. <br /> <br />04 - 329 - Presentations: <br /> <br />· Presentation by Ken Woolard, Chairman of the Museum and Fine Arts Commission, <br /> to the City of Portsmouth. <br /> <br />· Presentation to the City of Portsmouth by R. J. Nutter and Grif Lynch, on behalf of <br /> Maersk Sealand. <br /> <br />· Proclamation presented to Elaine Kubiszer for "Constitution Week." <br /> <br />· Introduction of visiting Belgium Firefighters by Deputy Fire Chief Newell Whitehead. <br /> <br />- Public Hearing - <br /> <br />04 - 330 - Public hearing on rezoning and street closure applications: <br /> <br />(a) Z-04-04 <br /> <br />DOWNTOWN NEIGHBORHOOD - Shirley Clayton requests to <br />rezone property at 705 Washington Street from Downtown D-1-M <br />mixed use (conditional) to Downtown D-1-M mixed use. <br /> <br /> Motion by Mr. Moody, and seconded by Ms. Randall, to concur with the <br />recommendation of the Planning Commission that Z-04-04 be approved on first reading, <br />and was adopted by unanimous vote. <br /> <br />(b) S-04-01 <br /> <br />PORT CENTRE COMMERCE PARK - Ordinance granting the <br />request of the Economic Development Authority and Portsmouth <br />Redevelopment and Housing Authority the closure of a portion of <br />Sixth Street between the northern and southern boundaries of <br />Nelson Street. The Comprehensive Plan encourages the closure of <br />unneeded rights-of-way which serve no traffic or land use functions. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Heretick, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE CLOSING AND VACATING A PORTION OF SIXTH STREET <br />BETWEEN THE NORTHERN AND SOUTHERN RIGHT OF WAY LINES OF NELSON <br />STREET." <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />(c) S-04-05 <br /> <br />HIGHLANDS NEIGHBORHOOD - Ordinance granting the request <br />of the City of Portsmouth and Mr. Russell Oliveira the street closure <br />of part of Gwaltney Court for the purpose of straightening the <br />alignment of the street. <br /> <br /> <br />
