August 24, 2004 <br /> <br />O83 <br /> <br /> WHEREAS, the City of Portsmouth supports the proposed Development including <br />the construction of the new railroad track. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia, that the City does hereby request that the Virginia Department of Rail and <br />Public Transportation give priority and favorable consideration to ARREFF's funding <br />application for the proposed new railroad track." <br /> <br />Ayes: Heretick, Moody, Psimas, Holley <br />Nays: Smith, Whitehurst <br /> <br />04 -315 - Adoption of a resolution confirming the Declaration of Emergency by the City <br />Manager for Hurricane Charley. <br /> <br />The City Manager signed the Declaration at 2:00 p.m. on August 14, 2004 in order <br />to prepare for the possibility of a local disaster caused by Hurricane Chadey. By <br />City Code, Council must confirm the declaration of the City Manager at its next <br />regular meeting or within 14 days of the declaration whichever occurs first. <br /> <br />Recommended Action: <br /> <br />· Adoption of a resolution confirming the Declaration of Emergency made by the City <br />Manager for Hurricane Charley on August 14, 2004. <br /> <br />Summary: <br /> <br />· The City Manager declared a state of emergency for the City of Portsmouth once the <br />Emergency Operations Center was activated on Saturday, August 14, 2004 in <br />anticipation of a potential disaster situation from Hurricane Charley. <br /> <br />Purpose and Need: <br /> <br />· By City Code, a local emergency may be declared by the director of emergency <br />services (City Manager), with the consent of the City Council. <br /> <br />· In the event the City Council cannot convene due to the disaster, the City Manager <br />may declare the existence of a local disaster subject to confirmation by the City Council <br />at its next regular meeting. <br /> <br />Financial Impact: <br /> <br />· The Declaration of Emergency allows the City to apply for assistance from State <br />and federal resources and to take whatever actions are necessary to protect the public <br />safety. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION CONFIRMING A DECLARATION OF EMERGENCY MADE BY THE <br />CITY MANAGER ON AUGUST 14, 2004. <br /> <br />BE IT RESOLVED by the Council of the City of Por[smouth, Virginia: <br /> <br /> 1. That the Declaration of Local Emergency, dated August 14, 2004, a copy of <br />which is attached hereto, made by Interim City Manager James B. Oliver, Jr., in <br />response to the conditions generated by Hurricane Charley, is hereby confirmed, <br />pursuant to Section 2-658 of the Code of the City of Portsmouth, Virginia (1988); and <br /> <br /> 2.
