080 <br /> <br />Au.qust 247 2004 <br /> <br /> 2. That Noble Street Baptist Church is hereby granted a use permit pursuant <br />to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to operate a <br />religious facility-based child care center (S.I.C. 835) at 100 Noble Street, and being <br />more particularly described as: <br /> UP-04-16 <br /> <br /> Beginning at the southeast corner of the intersection <br />of Noble Street and Portsmouth Boulevard: thence in <br />easterly direction 120' to a point; thence in a southerly <br />direction 266' to a point; thence in a westerly direction 120' <br />to a point; thence in a northerly direction for 266' to the <br />point of beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br />(a) The center shall care for no more than thirty children. <br /> <br />(b) <br /> <br />The ages of the children shall be limited to between one and four years <br />old. <br /> <br />(c) The hours of operation shall be limited to between 6:00 am and 6:00 pm. <br /> <br />(d) Outside playtime shall be limited to between 8:00 am and 6:00 pm. <br /> <br /> (e) The facility shall be constructed and operated in accordance with the site <br />plan and floor plan submitted. <br /> <br /> (f) The currently fenced-in area on the east side of the property shall be used <br />as a play yard for the center. The play area must, at all times, be at least 2,000 square <br />feet and be surrounded by a four-foot tall fence. <br /> <br /> (g) Landscaping shall be planted on the southern end of the play yard to <br /> buffer <br />the childcare facility from the adjacent residential use. <br /> <br /> (h) Six on-site parking spaces shall be allocated specifically for childcare drop <br />off and pickup. <br /> <br /> (i) Trash shall be stored and removed in accordance with the trash removal <br />plan dated June 14, 2004 approved by the Department of General Services. <br /> <br /> (j) The applicant shall have Fire Prevention, Health, and Building Department <br />inspections performed prior to occupancy of the childcare facility, and annual <br />inspections shall be conducted thereafter. <br /> <br /> (k) The facility shall comply with all applicable ordinances and regulations of <br />federal, state and local governments, and all necessary licenses and permits shall be <br />secured and maintained in effect. <br /> <br />Any taxes and fees associated with this property should be paid when <br />due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions mai <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />04-299(b): <br /> <br />"ZONING AMENDMENT ORDINANCE Z-04-03." <br /> <br />Ayes: Heretick, Moody, Psimas, Smith, Whitehurst, Holley <br />Nays: None <br /> <br /> <br />
