At a Regular Meeting <br />there were present: <br /> <br /> July 13, 2004 0,53 <br />of the City Council on Tuesday, July 13, 2004, <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., <br />Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. <br /> <br /> Councilman Charles B. Whitehurst, Sr. opened the meeting with prayer, which <br />was followed by the Pledge of Allegiance to the Flag. <br /> <br /> Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Smith, to approve the minutes of a <br />Called Meeting on June 22, 2004, a Regular Meeting on June 22, 2004, and a Called <br />Meeting on July 1,2004, and was adopted by unanimous vote. <br /> <br />04 - 273 - Presentations: <br /> <br />· Proclamation presented to Latisha Branch for "National Night Out." <br /> <br /> Presentation by Robin Holley Duke, Portsmouth Chapter American Red Cross, to <br /> the City of Portsmouth. <br /> <br />· Presentation of special lapel pins to newly appointed Board and Commission <br /> members. <br /> <br /> - Public Hearing - <br /> <br />04 - 274 - Public hearing on use permit applications: <br /> <br />(a) UP-04-10 TRUXTUN NEIGHBORHOOD - James Ravenell requests a use <br /> permit to operate a church at 2330 Portsmouth Boulevard. <br /> <br /> 1. Martha Ann Creecy, 317 Dinwiddie Street, spoke in opposition to this item. <br /> <br />2. James Ravenell, 610 Whisper Walk, Chesapeake, spoke in support of this item. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to concur with the <br />recommendation of the Planning Commission that UP-04-10 be denied on first and final <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley <br /> Nays: None <br /> <br />(b) UP-04-12 <br /> <br />WESTHAVEN NEIGHBORHOOD - Apostle Marion Jones, on <br />behalf of Saint Mark Deliverance Center, requests a use permit for <br />a religious facility based childcare center at 3801 Turnpike Road. <br /> <br />1. Ollie Powell, 3112 Tournament Drive, Chesapeake, spoke in support of this item. <br />2. Sonya Chapman, 2333 Elliott Avenue Apt. 2C, spoke in support of this item. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to concur with the <br />recommendation of the Planning Commission that UP-04-12 be approved on first <br />reading, and was adopted by unanimous vote. <br /> <br />(c) UP-04-15 DOWNTOWN NEIGHBORHOOD - Robert Anderson requests a <br /> use permit to operate an eating place at 1805 County Street. <br /> <br />1. Mark Geduldig-Yatrofsky, 363 Middle Street, spoke in support of this item. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the <br />recommendation of the Planning Commission that UP-04-15 be approved on first <br />reading, and was adopted by unanimous vote. <br /> <br /> <br />
