June 22,2004 Financial Impact: · This is a reimbursable grant and there is no local match required. Motion by Mr. Griffin, and seconded by Mr. Pitts, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE ACCEPTING A U. S. DEPARTMENT OF AGRICULTURE (USDA) GRANT AND APPROPRIATING $286,238 IN THE GRANTS FUND FOR THE USDA SUMMER FOOD PROGRAM." Ayes: Benn, Griffin, Moody, Pitts, Randall, Holley Nays: None 04 - 253 - Adoption of a resolution to allow the amount of change orders on the Ntelos replacement contract with Span Systems, Inc. to exceed 25% of the original contract. Recommendation: · Adoption of a Resolution to allow the amount of change orders on the Ntelos replacement contract with Span Systems, Inc. to exceed 25% of the original contract. Purpose and Need: · The City of Portsmouth entered into a contract with Span Systems, Inc. for the redesign and replacement of the Ntelos Pavilion canopy following Hurricane Isabel. The original contract was for $1,261,000. The redesign of the facility has necessitated changes and additions to the original structure that has exceeded the 25% limit. Financial Impact: · The revised contract total is within the funds that have been appropriated. Motion by Mr. Benn, and seconded by Mr. Pitts, to adopt the following resolution, and was adopted by the following vote: "A RESOLUTION AUTHORIZING THE EXPENDITURE OF ADDITIONAL FUNDS FOR REPLACEMENT OF NTELOS PERFORMING ARTS CENTER ROOF. WHEREAS, on November 25, 2003, the City Council authorized the execution of a contract in the amount of $1,511,000 with SPAN Systems for replacement of the Ntelos Performing Arts Center roof that was damaged during Hurricane Isabel in September 2003; and WHEREAS, the Portsmouth City Code provides that no fixed price contract may be increased by more than $50,000 or 25%, whichever is greater, without the approval of City Council; and WHEREAS, City Council on June 8, 2004, appropriated the amount of $2.5 million for the total repairs to the Ntelos facility; and WHEREAS, unforeseen design and construction conditions will result in an increase to the City's contract with SPAN Systems of more than 25%. NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that it hereby approves the additional expenditure of appropriated funds exceeding 25% of the original contract amount with SPAN Systems, and the City Manager is authorized to approve such expenditures, as he deems necessary and appropriate.
