June 22,2004 <br /> <br />Financial Impact: <br /> <br />· This is a reimbursable grant and there is no local match required. <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Pitts, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE ACCEPTING A U. S. DEPARTMENT OF AGRICULTURE (USDA) <br />GRANT AND APPROPRIATING $286,238 IN THE GRANTS FUND FOR THE USDA <br />SUMMER FOOD PROGRAM." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Randall, Holley <br />Nays: None <br /> <br />04 - 253 - Adoption of a resolution to allow the amount of change orders on the Ntelos <br />replacement contract with Span Systems, Inc. to exceed 25% of the original contract. <br /> <br />Recommendation: <br /> <br />· Adoption of a Resolution to allow the amount of change orders on the Ntelos <br />replacement contract with Span Systems, Inc. to exceed 25% of the original contract. <br /> <br />Purpose and Need: <br /> <br />· The City of Portsmouth entered into a contract with Span Systems, Inc. for the <br />redesign and replacement of the Ntelos Pavilion canopy following Hurricane Isabel. <br />The original contract was for $1,261,000. The redesign of the facility has necessitated <br />changes and additions to the original structure that has exceeded the 25% limit. <br /> <br />Financial Impact: <br /> <br />· The revised contract total is within the funds that have been appropriated. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Pitts, to adopt the following resolution, <br />and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE EXPENDITURE OF ADDITIONAL FUNDS <br />FOR REPLACEMENT OF NTELOS PERFORMING ARTS CENTER ROOF. <br /> <br /> WHEREAS, on November 25, 2003, the City Council authorized the execution of <br />a contract in the amount of $1,511,000 with SPAN Systems for replacement of the <br />Ntelos Performing Arts Center roof that was damaged during Hurricane Isabel in <br />September 2003; and <br /> <br /> WHEREAS, the Portsmouth City Code provides that no fixed price contract may <br />be increased by more than $50,000 or 25%, whichever is greater, without the approval <br />of City Council; and <br /> <br /> WHEREAS, City Council on June 8, 2004, appropriated the amount of $2.5 <br />million for the total repairs to the Ntelos facility; and <br /> <br /> WHEREAS, unforeseen design and construction conditions will result in an <br />increase to the City's contract with SPAN Systems of more than 25%. <br /> <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it hereby approves the additional expenditure of appropriated funds <br />exceeding 25% of the original contract amount with SPAN Systems, and the City <br />Manager is authorized to approve such expenditures, as he deems necessary and <br />appropriate. <br /> <br /> <br />
