At a Cai!ed Meeting of the City Council on Tuesday, May 11, 2004, there were present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />J. Thomas Benn Ill, William E. Moody, Jr., Charles B. Whitehurst, Sr., *Marlene W. Randall, <br />City Manager C. W. MCCoy~ City Attorney G. Timothy Oksman. <br /> <br />04 - 170 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City Manager's <br />Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday; May 11, 2004 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />04 - 171 - The following item was discussed in Public Work Session: <br /> <br />1. Budget Follow-u ~ - Lee A. Dumbauld <br /> <br />04 - 172 - Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed Meeting <br />2ursuant to provisions of Section 2.2-3711 (A)(7) of the Code of Virginia, to discuss or consider <br />the foliowing: <br /> <br /> - consult with legal counsel and staff -nembers pertaining to actual or probable <br />litigation, and to discuss other specific legal matters requmng the advice of legal counsel. <br /> <br /> The subject matter of the meeting will be potential litigation against the City, and also <br />other legal matters involving interpretation of the laws of the Commonwealth of Virginia and the <br />United States, requiring the advice of legal counsel. <br /> <br /> The purpose of the meeting is to protect the financial interests of the City and its <br />taxpayers by not disclosing confidential information and strategy that may be used against the <br />City by potential litigants. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurs~, pursuant to Section 2.2-3712(D) <br />of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the <br />immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting requirements by <br /> the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which the <br />Closed Meeting was convened, were heard, discussed or considered in the meeting <br />by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />On motion, meeting adjourned. <br /> <br />Mir)utes prepare~ - // <br />Senior Deputy City Clerk <br /> <br />APPROVED - <br /> <br />Dr. James W.
