At a Cai!ed Meeting of the City Council on Tuesday, May 11, 2004, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn Ill, William E. Moody, Jr., Charles B. Whitehurst, Sr., *Marlene W. Randall, City Manager C. W. MCCoy~ City Attorney G. Timothy Oksman. 04 - 170 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday; May 11, 2004 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 04 - 171 - The following item was discussed in Public Work Session: 1. Budget Follow-u ~ - Lee A. Dumbauld 04 - 172 - Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed Meeting 2ursuant to provisions of Section 2.2-3711 (A)(7) of the Code of Virginia, to discuss or consider the foliowing: - consult with legal counsel and staff -nembers pertaining to actual or probable litigation, and to discuss other specific legal matters requmng the advice of legal counsel. The subject matter of the meeting will be potential litigation against the City, and also other legal matters involving interpretation of the laws of the Commonwealth of Virginia and the United States, requiring the advice of legal counsel. The purpose of the meeting is to protect the financial interests of the City and its taxpayers by not disclosing confidential information and strategy that may be used against the City by potential litigants. The motion was adopted by unanimous vote. Motion by Mr. Moody, and seconded by Mr. Whitehurs~, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
