April 27, 2004 <br /> <br />Purpose and Need: <br /> <br />· Currently, the Police Auxiliary Officers and Chaplains are not covered under <br />Worker's Compensation for services they provide to the City of Portsmouth as <br />volunteers. <br /> <br />· This resolution will provide a designation of Police Auxiliary Officers and Chaplains <br />as employees for the purposes of Worker's Compensation only. <br /> <br />· Currently, the Auxiliary Sheriff's Deputies are deemed employees of the City for <br />Worker's Compensation purposes only as adopted by the Council of the City of <br />Portsmouth at a meeting held on September 25, 1990. <br /> <br />Financial Impact: <br /> <br />· The financial impact cannot be determined at this time. This will depend on any <br />future claims for injuries sustained while providing services in an official capacity for the <br />City. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION ACKNOWLEDGING POLICE CHAPLAINS AND AUXILIARY <br />OFFICERS AS CITY EMPLOYEES FOR PURPOSES OF WORKER'S <br />COMPENSATION BENEFITS COVERAGE. <br /> <br /> WHEREAS, police chaplains and police auxiliary officers, through their voluntary <br />unpaid service, supplement greatly the law enforcement efforts of the City of <br />Portsmouth; and <br /> <br /> WHEREAS, police chaplains and police auxiliary officers have heretofore not <br />been designated as city employees for the purpose of worker's compensation coverage; <br />and <br /> <br /> WHEREAS, Section 65.2-102 of the Code of Virginia (1950), as amended, <br />provides for the designation of such individuals as city employees solely for the purpose <br />of such coverage; and <br /> <br /> WHEREAS, the City Council finds that such designation solely for the purpose of <br />worker's compensation benefits coverage will benefit those individuals who serve as <br />police chaplains and auxiliary police officers and may also encourage other individuals <br />to volunteer their services to the City. <br /> <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that the City's appreciation for the invaluable services of the police chaplains <br />and the auxiliary police officers is hereby expressed, and that all persons serving in <br />such capacities are hereby designated city employees solely for the purpose of <br />coverage under the worker's compensation provisions of state law as permitted under <br />Va. Code section 65.2-102." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Whitehurst, Holley <br />Nays: None <br /> <br />04 - 160 - Adoption of a resolution requesting that the United States Congress restore <br />full funding to the Army Corps of Engineers for the operation and maintenance of the <br />Great Dismal Swamp. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution requesting that the United States Congress restore full <br />funding to the Army Corps of Engineers for the operation and maintenance of the Great <br />Dismal Swamp Canal. <br /> <br /> <br />
