April 27, 2004 <br /> <br />(d) The site shall be limited to a maximum of 95,000 net leasable square feet. <br /> <br /> (e) <br />p.m. <br /> <br />Hours of operation shall be limited to the hours between 6:00 a.m. to 9:00 <br /> <br />(f) Customer access shall only take place from Western Branch Boulevard. <br /> <br /> (g) The applicant shall provide and maintain at least two (2) parking spaces <br />for employee parking. <br /> <br /> (h) The portion of the self-storage facility abutting the residentially zoned <br />properties to the immediate east shall not be placed closer than 70 feet from the <br />property line. <br /> <br /> (i) A twenty-foot wide strip landscaped buffer shall be preserved along the <br />property line abutting the residentially zoned properties to the immediate east. <br /> <br /> (j) The proposed stormwater management facility shall be formally reviewed <br />and approved by the City Engineer. <br /> <br /> (k) The project shall comply with the trash-handling plan approved by the <br />Department of General Services on February 17, 2004, which allows for one screened <br />dumpster serviced by a private company. <br /> <br /> (I) The site plan shall comply with the City of Chesapeake Traffic Engineer's <br />recommendations. <br /> <br /> (m) The proposed project shall submit to the site plan review process prior to <br />the issuance of the Certificate of Occupancy. <br /> <br /> (n) The applicant shall obtain all required licenses and permits and shall <br />maintain them in full force and effect. <br /> <br /> (o) All taxes and fees in connection with the subject property and operation <br />shall be paid when due. <br /> <br /> 2. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-106.1 of the Code of the City of Portsmouth, Virginia (1988), the use permit shall <br />expire for any portion of the approved project for which building permits have not been <br />issued if the applicant fails to apply for all building permits for the entire project within <br />one year of the adoption of this resolution. <br /> <br /> 3. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />04 - 159 - Adoption of a resolution to deem Police Auxiliary Officers and Chaplains as <br />employees of the City of Portsmouth for Worker's Compensation purposes only. <br /> <br />The purpose of this designation is to provide worker's compensation benefits to <br />these volunteers while they are performing services for the City in an official <br />capacity. <br /> <br />Recommendation: <br /> <br />· Adoption of resolution to deem Police Auxiliary Officers and Chaplains as employees <br />of the City for Worker's Compensation purposes only. <br /> <br /> <br />
