February 10, 2004 <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />04 - 62 - Adoption of an ordinance to amend Chapter 31.1 of the Code of the City of <br />Portsmouth Sections 31.1 (b) and (d) pertaining to pollution of the stormwater system <br />and to add a new section, 31.1-3(d), relating to enforcement. <br /> <br />These changes will increase the penalty for polluting the storm drain system, <br />raise the fine from $500 to $1,000, and enable police officers and fire marshals to <br />enforce the Code. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to amend Section 31.1-3(b) of the Portsmouth City Code <br />pertaining to pollution of the stormwater system and to add a new section, 31.1-3(d), <br />pertaining to enforcement. <br /> <br />Purpose and Need: <br /> <br />· Revisions to Section 31.1-3(b) increase the penalty for polluting the storm drain <br />system from a Class 3 misdemeanor to a misdemeanor, and raise the fine from $500 to <br />$1,000. Such revisions will provide more leverage to ensure compliance. <br /> <br />· The addition of Section 31.1-3(d) allows police officers and fire marshals to enforce <br />the stormwater ordinances in addition to the City's inspectors. This broadens <br />enforcement capabilities. <br /> <br />Financial Impact: <br /> <br />· There will be minor increases in revenue due to higher fines. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND CHAPTER 31.1 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 31.1-1 AND 31.1-3 <br />THEREOF PERTAINING TO STORMWATER MANAGEMENT." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />- New Business - <br /> <br />04 - 63 - Boards and Commissions <br /> <br />There were no appointments. <br /> <br />Councilman Benn complimented the City Clerk and staff on the Boards and <br />Commissions Retreat held on Saturday, February 7, 2004. <br /> <br />04 - 64 - Items Submitted by Council Members <br /> <br />Adoption of a joint resolution between the Council of the City of Portsmouth and the <br />School Board of the City of Portsmouth. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Benn, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />JOINT RESOLUTION <br /> <br /> WHEREAS, the City of Portsmouth has a unique financial challenge among the <br />localities in the Commonwealth of Virginia in that over 56% of its land area is tax <br />exempt; and <br /> <br /> <br />
