February 10, 2004 <br /> <br />Purpose and Need: <br /> <br />· The majority of Chapter 13 (Fire Protection and Prevention) has not been updated <br />since 1973. <br /> <br />· Amendments are recommended to update the Code with reference to department <br />name, position titles, and section language with proper and modern terminology. <br /> <br />· Other amendments recommended will update the Chapter to reflect the Virginia <br />Statewide Fire Prevention Code. <br /> <br />Financial Impact: <br /> <br />· There is no financial impact. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND CHAPTER 13 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 13-5, 13-7, 13-32, <br />13-56, 13-57, 13-58, 13-59, 13-62, 13-82, 13-83, 13-86, 13-88, 13-89 (a) THROUGH (I), <br />(m)(5), (n)(1), (r), AND (t), 13-103, 13-116, 13-117, 13-119, 13-131, AND 13-134, BY <br />THE ADOPTION OF NEW SECTIONS 13-31, 13-33 AND 13-34 AND BY THE <br />REPEAL OF SECTION 13-6 AND 13-60 PERTAINING TO FIRE PROTECTION AND <br />PREVENTION." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />04 - 61 - Adoption of an ordinance to amend Chapter 16 of the Code of the City of <br />Portsmouth, Virginia pertaining to garbage and refuse. <br /> <br />These changes will enable police officers and fire marshals to arrest or issue <br />summonses for the illegal dumping of trash, debris and hazardous materials. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to amend of Chapter 16, Sections 16.5(b)(e) pertaining to <br />garbage and refuse. <br /> <br />Purpose and Need: <br /> <br />· These amendments will provide more control of dumping trash and other unsightly <br />matter in the City by enabling the assistance of police officers and fire marshals to cite <br />violations especially related to potentially hazardous materials. <br /> <br />· These amendments broaden the capacity for enforcement for these violations. <br /> <br />· The recommendations for these amendments came from the Neighborhood Quality <br />Action Team comprised of representatives from many departments working together to <br />focus on the Neighborhood Quality Sphere of Success. <br /> <br />Financial Impact: <br /> <br />· There is no financial impact. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Ms. Randall, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND CHAPTER 16 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 16-5 THEREOF <br />PERTAINING TO GARBAGE AND REFUSE." <br /> <br /> <br />
