February 10, 2004 Purpose and Need: · The majority of Chapter 13 (Fire Protection and Prevention) has not been updated since 1973. · Amendments are recommended to update the Code with reference to department name, position titles, and section language with proper and modern terminology. · Other amendments recommended will update the Chapter to reflect the Virginia Statewide Fire Prevention Code. Financial Impact: · There is no financial impact. Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE TO AMEND CHAPTER 13 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 13-5, 13-7, 13-32, 13-56, 13-57, 13-58, 13-59, 13-62, 13-82, 13-83, 13-86, 13-88, 13-89 (a) THROUGH (I), (m)(5), (n)(1), (r), AND (t), 13-103, 13-116, 13-117, 13-119, 13-131, AND 13-134, BY THE ADOPTION OF NEW SECTIONS 13-31, 13-33 AND 13-34 AND BY THE REPEAL OF SECTION 13-6 AND 13-60 PERTAINING TO FIRE PROTECTION AND PREVENTION." Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley Nays: None 04 - 61 - Adoption of an ordinance to amend Chapter 16 of the Code of the City of Portsmouth, Virginia pertaining to garbage and refuse. These changes will enable police officers and fire marshals to arrest or issue summonses for the illegal dumping of trash, debris and hazardous materials. Recommendation: · Adoption of an ordinance to amend of Chapter 16, Sections 16.5(b)(e) pertaining to garbage and refuse. Purpose and Need: · These amendments will provide more control of dumping trash and other unsightly matter in the City by enabling the assistance of police officers and fire marshals to cite violations especially related to potentially hazardous materials. · These amendments broaden the capacity for enforcement for these violations. · The recommendations for these amendments came from the Neighborhood Quality Action Team comprised of representatives from many departments working together to focus on the Neighborhood Quality Sphere of Success. Financial Impact: · There is no financial impact. Motion by Mr. Whitehurst, and seconded by Ms. Randall, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE TO AMEND CHAPTER 16 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 16-5 THEREOF PERTAINING TO GARBAGE AND REFUSE."
