Februar~ 10, 2004 At a Regular Meeting of the City Council on Tuesday, February 10, 2004, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. Councilman J. Thomas Benn III opened the meeting with prayer, which was followed by the Pledge of Allegiance to the Flag. Mayor Holley called the meeting to order and welcomed all in attendance. Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a Called Meeting on January 26, 2004, a Called Meeting on January 27, 2004, a Regular Meeting on January 27, 2004, and a Called Meeting on February 2, 2004, and was adopted by unanimous vote. 04 - 57 - Presentation: · Proclamation presented to Anne Green and Sergeant Stephen Jackson for"NEAT Summit Day." - Public Hearing - 04 - 58 - Public hearing on use permit applications: (a) UP-03-29 PORT NORFOLK NEIGHBORHOOD - Broad Street Methodist Church requests a use permit for a childcare center for 72 children at 300 Broad Street. The property is located in the Port Norfolk Historic District. 1. Maria Peed, 314 Russell Street, spoke in support of this item. Motion by Mr. Pitts, and seconded by Mr. Moody, to concur with the recommendation of the Planning Commission that UP-03-29 be approved on first reading, and was adopted by unanimous vote. (b) UP-04-02 DOWNTOWN NEIGHBORHOOD - Tim and Shannon Woodland request a use permit to establish an entertainment establishment at 300 High Street. 1. Shannon Woodland, 480 Middle Street, spoke in support of this item. Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the recommendation of the Planning Commission that UP-04-02 be approved on first reading, and was adopted by unanimous vote. - Unfinished Business - 04 - 08 - Use permit: (b) UP-03-27 MERRIFIELDS NEIGHBORHOOD - Diane Ferebee requests a use permit to operate a family day care home for children at 4224 Swannanoa Drive. Deferred from the January 13, 2004 City Council meeting. 1. Mark Geduldig-Yatrofsky, 363 Middle Street, spoke in support of this item. 2. Anthony Ferebee, 4224 Swannanoa Drive, spoke in support of this item. Motion by Mr. Moody, and seconded by Mr. Whitehurst, to deny item UP-03-27.
