January 13, 2004 <br /> <br /> At a Regular Meeting of the City Council on Tuesday, January 13, 2004, <br />there were present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. <br />Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br /> Councilwoman Marlene W. Randall opened the meeting with prayer, which was <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a <br />Called Meeting on December 16, 2003, and a Regular Meeting on December 16, 2003, <br />and was adopted by unanimous vote. <br /> <br />04 - 07 - Presentation: <br /> <br />· Presentation of the City of Norfolk's Chairman's Award for the Grand Illumination <br /> Parade to the City of Portsmouth. <br /> <br />- Public Hearing - <br /> <br />04 - 08 - Public hearing on use permit, rezoning, and code amendment and street <br />applications: <br /> <br />(a) UP-03-27 <br /> <br />MERRIFIELDS NEIGHBORHOOD - Diane Ferebee requests a use <br />permit to operate a family day care home for children at 4224 <br />Swannanoa Drive. <br /> <br />1. Diane Ferebee, 4224 Swannanoa Drive, spoke in support of this item. <br /> <br />2. Mark Geduldig-Yatrofsky, 363 Middle Street, spoke on this item. <br /> <br />3. James Overton, 315 Astor Avenue, spoke in support on this item. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Pitts, to defer consideration of <br />UP-03-27 to the meeting of February 10, 2004 to have the present fence removed and a <br />proposal for an acceptable fence developed, and was adopted by a vote of 6-1 (Holley). <br /> <br />(b) UP-03-28 <br /> <br />DOWNTOWN NEIGHBORHOOD - Thomas Sherrill requests a use <br />permit to operate a restaurant at 341 High Street. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Moody, to defer consideration of <br />UP-03-28 to the public hearing meeting of January 27, 2004, and was adopted by <br />unanimous vote. <br /> <br />(c) UP-03-30 <br /> <br />OLDE TOWNE NEIGHBORHOOD -William Roach requests a use <br />permit to establish a duplex at 447-449 Dinwiddie Street. The <br />property is located in the Historic Limited Office (HLO) District. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to concur with the <br />recommendation of the Planning Commission that UP-03-30 be approved on first <br />reading, and was adopted by unanimous vote. <br /> <br />(d) UP-03-31 <br /> <br />CHURCHLAND NEIGHBORHOOD - Diane Wells requests a use <br />permit for a childcare center in Space #12 of the Churchland <br />Shopping Center located at 5760 Churchland Boulevard. <br /> <br />1. Cynthia Hill, 3869 Peachtree Lane West, spoke in support of this item. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Pitts, to concur with the <br />recommendation of the Planning Commission that UP-03-31 be approved on first <br />reading, and was adopted by a vote of 6-1 (Griffin). <br /> <br /> <br />
