January 13, 2004 At a Regular Meeting of the City Council on Tuesday, January 13, 2004, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. Councilwoman Marlene W. Randall opened the meeting with prayer, which was followed by the Pledge of Allegiance to the Flag. Mayor Holley called the meeting to order and welcomed all in attendance. Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a Called Meeting on December 16, 2003, and a Regular Meeting on December 16, 2003, and was adopted by unanimous vote. 04 - 07 - Presentation: · Presentation of the City of Norfolk's Chairman's Award for the Grand Illumination Parade to the City of Portsmouth. - Public Hearing - 04 - 08 - Public hearing on use permit, rezoning, and code amendment and street applications: (a) UP-03-27 MERRIFIELDS NEIGHBORHOOD - Diane Ferebee requests a use permit to operate a family day care home for children at 4224 Swannanoa Drive. 1. Diane Ferebee, 4224 Swannanoa Drive, spoke in support of this item. 2. Mark Geduldig-Yatrofsky, 363 Middle Street, spoke on this item. 3. James Overton, 315 Astor Avenue, spoke in support on this item. Motion by Mr. Moody, and seconded by Mr. Pitts, to defer consideration of UP-03-27 to the meeting of February 10, 2004 to have the present fence removed and a proposal for an acceptable fence developed, and was adopted by a vote of 6-1 (Holley). (b) UP-03-28 DOWNTOWN NEIGHBORHOOD - Thomas Sherrill requests a use permit to operate a restaurant at 341 High Street. Motion by Mr. Benn, and seconded by Mr. Moody, to defer consideration of UP-03-28 to the public hearing meeting of January 27, 2004, and was adopted by unanimous vote. (c) UP-03-30 OLDE TOWNE NEIGHBORHOOD -William Roach requests a use permit to establish a duplex at 447-449 Dinwiddie Street. The property is located in the Historic Limited Office (HLO) District. Motion by Mr. Whitehurst, and seconded by Mr. Moody, to concur with the recommendation of the Planning Commission that UP-03-30 be approved on first reading, and was adopted by unanimous vote. (d) UP-03-31 CHURCHLAND NEIGHBORHOOD - Diane Wells requests a use permit for a childcare center in Space #12 of the Churchland Shopping Center located at 5760 Churchland Boulevard. 1. Cynthia Hill, 3869 Peachtree Lane West, spoke in support of this item. Motion by Mr. Whitehurst, and seconded by Mr. Pitts, to concur with the recommendation of the Planning Commission that UP-03-31 be approved on first reading, and was adopted by a vote of 6-1 (Griffin).
