December 16, 2003 Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the recommendation of the Planning Commission that CA-03-04 be approved on first reading, and was adopted by unanimous vote. (d) CA-03-05 CITYWIDE - The City of Portsmouth proposes to amend Chapter 40 of the Portsmouth City Code - Zoning Ordinance - to establish the Traditional Neighborhood Development Overlay District (TND). The purpose of the TND Overlay District is to allow for the development of fully integrated, pedestrian oriented, mixed use neighborhoods based upon established TND design principles. 1. William E. Copeland, 2107 Staunton Avenue, inquired about lots sizes. Motion by Mr. Whitehurst, and seconded by Mr. Moody, to concur with the recommendation of the Planning Commission that CA-03-05 be approved on first reading, and was adopted by unanimous vote. (e) CA-03-07 CITYWIDE - The City of Portsmouth proposes to amend Chapter 40 of the Portsmouth City Code - (Zoning Ordinance) relating to the use and placement of freight containers. 1. Noel Smith, 4608 Steeton Court, Chesapeake, spoke in opposition to this item. Motion by Mr. Benn, and seconded by Ms. Randall, to concur with the recommendation of the Planning Commission that CA-03-07 be approved on first reading, and was adopted by unanimous vote. (f) S-03-08 SIMONSDALE NEIGHBORHOOD - Ordinance granting the request of the City of Portsmouth for approval to close the alley that runs between North Colin Drive and Vick Street. The alley is between 20 and 22 North Colin Drive and 4817 and 4819 Vick Street. The portion of the alley to be closed is 10 feet wide and approximately 275.45 feet in length. Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE CLOSING AND VACATING A PEDESTRIAN EASEMENT BETWEEN NORTH COLIN DRIVE AND VlCK STREET." Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley Nays: None - Unfinished Business - Consent Aqenda 03 - 422 - Use permits: Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following resolutions, approved on first reading at the November 25, 2003 meeting, and was adopted by the following vote: 03-422(a): "A RESOLUTION GRANTING A USE PERMIT FOR A TRANSLOADING AND WAREHOUSING FACILITY AT 3600 ELM AVENUE. WHEREAS, Arreff Terminals, Inc., has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a transloading and warehousing facility at 3600 Elm Avenue; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and
