<br /> At a Regular Meeting of the City Council on Tuesday, December 16, 2003,
<br />there were present:
<br />
<br />*Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts,
<br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W.
<br />Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman.
<br />
<br /> Councilman Cameron C. Pitts opened the meeting with prayer, which was
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a
<br />Called Meeting on October 27, 2003, a Called Meeting on October 28, 2003, a Regular
<br />Meeting on October 28, 2003, a Called Meeting on November 10, 2003, a Called
<br />Meeting on November 14, 2003, a Called Meeting on November 16, 2003, a Called
<br />Meeting on November 17, 2003, a Called Meeting on November 18, 2003, a Called
<br />Meeting on November 25, 2003, and a Regular Meeting on November 25, 2003, and
<br />was adopted by unanimous vote.

<br />03 - 439 - Presentations:
<br />
<br />· Presentation of the United States of America Flag flown in Afghanistan over a U. S.
<br /> Base from Clyde Taler to Mayor Halley.
<br />
<br />· Presentation of special lapel pins to newly appointed Board and Commission
<br /> members.
<br />
<br />- Public Hearing -
<br />
<br />03 - 440 - Public hearing on rezaning, use permit, code amendment and street closure
<br />applications:

<br />(a) Z-03-17
<br />
<br />DOWNTOWN CORRIDOR Hampton Roads Services, LLC
<br />requests a rezoning from heavy industrial (M-2) to heavy industrial
<br />conditional (M-2-K), for an empty container storage depot at 800
<br />Constitution Avenue.
<br />
<br /> Motion by Mr. Benn, and seconded by Mr. Griffin, to concur with the
<br />recommendation of the Planning Commission that Z-03-17 be approved on first reading,
<br />and was adopted by unanimous vote.
<br />
<br />(b) UP-03-24
<br />
<br />DOWNTOWN CORRIDOR Hampton Roads Services, LLC
<br />requests a use permit for an empty container storage depot at 800
<br />Constitution Avenue.
<br />
<br />1. Jeff Keever, 800 Constitution Avenue, spoke in support of this item.
<br />
<br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to amend the
<br />recommendation of the Planning Commission that containers be stacked no more than
<br />three (3) high versus four (4) high. Motion was withdrawn.
<br />
<br /> Motion by Mr. Benn, and seconded by Mr. Griffin, to concur with the
<br />recommendation of the Planning Commission that UP-03-24 be approved on first
<br />reading, and was adopted by unanimous vote.
<br />
<br />(c) CA-03-04
<br />
<br />CITYWIDE - The City of Portsmouth proposes to amend Chapter
<br />9.1 of the Portsmouth City Code The Chesapeake Bay
<br />Preservation Area Overlay Ordinance, to comply with Chapter 21 of
<br />the Virginia State Code - The Bay Act. The regulations were
<br />amended to clarify allowable activities in and permitted
<br />modifications of the Resource Protection Area 100 foot buffer.
