December 16, 2003 <br /> <br />Councilman Pitts spoke on the National League of Cities, serving as the senior <br />member of Transportation Infrastructure and Services Committee and reported that <br />all of the amendments and changes Portsmouth made to the Harbor Port and Policy <br />were accepted and passed. <br /> <br />03 - 448 - Non-Agenda Speakers <br /> <br />1. J. Brewer Moore, 308 Bobby Jones Drive, spoke on local tax relief and a municipal <br /> merger as proposed by State Delegate Johnny Joannou. <br /> <br />Jeffrey Sacks, 870 N. Military Highway, Suite 300, Norfolk, Attorney, representing <br />Mr. Amos Berkovich for disposition parcel 191 of the Crawford Renewal Project for <br />an International House of Pancakes Restaurant. Presented Portsmouth <br />Redevelopment and Housing Authority (PRHA) Resolution No. 4694 to be retained. <br />(Filed with original minutes). <br /> <br />Deborah Schwind, 17 Wayland Drive, complimented Council on recent retreat. Also, <br />she spoke on the need for improvements in education and an economic stimulus for <br />attracting the best teachers. <br /> <br />4. Terry Morrison, 5807 Woodside Lane, spoke on the authority of the Wetland Boards <br /> to earmark funds from enforcement actions to improve the environment. <br /> <br />5. William E. Copeland, 2107 Staunton Avenue, spoke on various items concerning the <br /> City of Portsmouth. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Griffin, to go into Closed Meeting <br />pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or <br />consider the following: <br /> <br />specific legal matters requiring legal advice, as authorized by paragraph 7; <br /> <br /> the award of a public contract involving the expenditure of public funds, where <br />discussion in an open session would adversely affect the City's bargaining position or <br />negotiating strategy, as per subsection 30; and <br /> <br /> the acquisition or sale of real property for a public purpose, as per <br />subsection 3. <br /> <br /> The subject matter of the meeting will be legal matters in the nature of litigation <br />involving the City, competition in connection with a public contract, and also possible <br />acquisition of land for a public purpose, and possible sale and development of publicly <br />owned land. <br /> <br /> The purpose of the meeting is to permit frank and confidential discussion of <br />matters for which premature public disclosure could materially harm the financial <br />interests of the City and its citizens. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> <br />
