November 14, 2003 WHEREAS, the closure of the nTelos Pavilion has seriously affected and will continue to affect the City of Portsmouth by the loss of taxes and other revenues related tc the Pavilion's operation, by the loss of business proceeds for City merchants, and by the removal of a major local entertainment site and icon for the citizens of the City; and WHEREAS, time is of the essence with respect to the replacement of the roof if the Pavilion is to reopen for the full 2004 concert season; and WHEREAS, it is in the best interest of the City that neither sealed bids nor competitive negotiations be required as part of the procurement process for the nTelos Pavilion roof repairs because the additional time necessitated by the sealed bid and competitive negotiation processes makes timely completion of the repairs infeasible. NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that pursuant to Section 12-215 (c) of the Code of the City of Portsmouth.- Virginia (1988), the City Manager be, and he hereby ~s, authorized to select a proposed contractor for the repair of the nTelos Pavilion under such terms and conditions as he shall deem in the best interest of the City. In so doing, the City Manager shall give appropriate weight to the following four criteria: (a) price; (b) the ability to complete the work expediently; (c) experience and qualifications; and (d) integrity and honesty. BE IT FURTHER RESOLVED that the City Manager shall recommend that proposed contractor to City Council for its approval and authorization supported by such facts and reasons as support his recommendation."
