November 14, 2003 At a Called Meeting of the City Council on Friday, November 14, 2003, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. 03 - 403 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to Manager's Conference Room, 801 Crawford Street, 6th floor, November 14, 2003 for the purpose of a Closed Meeting. be held in the City 5:30 p.m., Friday, In addition, you may be asked to vote on a resolution authorizing the City Manager to negotiate and enter into a contract to replace the roof structure for Harbor Center. By order of the Mayor." 03 - 404 - Motion by Mr. Griffin, and seconded by Ms. Randall, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or consider the following: to consult with legal counsel about specific legal matters requiring legal advice, as authorized by paragraph 7. The subject matter shall be legal matters involving interpretation of the laws of the Commonwealth of Virginia and probable litigation. The purpose shall be to protect the financial interests of the City and its taxpayers. The motion was adopted by unanimous vote. Motion by Mr. Griffin, and seconded by Mr. Pitts, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote. 03 - 405 - Adoption of a resolution authorizing the City Manager to negotiate and recommend a contract for repair of the nTelos Pavilion at Harbor Center. Motion by Mr. Benn, and seconded by Mr. Whitehurst, to adopt the following resolution, and was adopted by the following vote: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND RECOMMEND A CONTRACT FOR REPAIR OF THE NTELOS PAVILION AT HARBOR CENTER. WHEREAS, on September 18, 2003, the roof of the nTelos Pavilion at Harbor Center was severely damaged by storm-related winds; and WHEREAS, performances at the Pavilion for the remainder of 2003 were canceled as a result of the damage, and performances for the 2004 season cannot be scheduled unless the timely replacement of the roof is assured; and
