September 23, 2003 <br /> <br />Purpose and Need: <br /> <br />· Any declaration of emergency by the City Manager must be submitted to City <br />Council for confirmation within fourteen days. The Evacuation Curfew is in the nature of <br />a declaration of emergency, and it is thus being brought before City Council. <br /> <br />Financial Impact: <br /> <br />· The imposition of this Evacuation Curfew by the City Manager had a significant <br />positive financial impact on the City, which cannot be accurately quantified: acts of civil <br />disorder which had begun prior to imposition of the Evacuation Curfew effectively <br />ceased once the Evacuation Curfew had been declared. <br /> <br />"A RESOLUTION CONFIRMING AN EVACUATION CURFEW DECLARED BY THE <br />CITY MANAGER FOR HURRICANE ISABEL. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />Evacuation Curfew declared by the City Manager, C. W. McCoy for Hurricane Isabel, <br />dated September 19, 2003, a copy of which is attached hereto, including any <br />subsequent amendments hereto, is hereby confirmed pursuant to Portsmouth City <br />Code 2-658." <br /> <br />~ Adoption of an ordinance to amend and reordain the Code of the City of Portsmouth <br />by adding thereto a new Article within Chapter 2, Article XXIII, related to Emergency <br />Curfews. <br /> <br />Recommendation: <br /> <br />· Adoption of an amendment to the Portsmouth City Code to authorize the imposition <br />of a temporary Emergency Curfew when a state of emergency has been declared. <br /> <br />Purpose and Need: <br /> <br />· Existing law is unclear about the City's legal authority to impose a temporary <br />Emergency Curfew when a state of emergency has been declared. <br /> <br />· In an emergency, the prompt imposition of a curfew may be needed in order to <br />protect public safety, public welfare, public and private property, and good order. The <br />proposed amendments to provide clear legal authority for the City Manager to do so, <br />subject to later review by City Council. <br /> <br />Financial Impact: <br /> <br />· There is no direct financial impact. There is a positive indirect financial impact: at <br />such time as it may become necessary to impose an Emergency Curfew, it can be <br />expected to prevent the possible damage or destruction of significant amounts of public <br />and private property, which could entail very substantial financial loss. <br /> <br />"ORDINANCE TO AMEND AND REORDAIN THE CODE OF THE CITY OF <br />PORTSMOUTH BY ADDING THERETO A NEW ARTICLE WITHIN CHAPTER 2, <br />ARTICLE XXlII, RELATED TO EMERGENCY CURFEWS." <br /> <br />- Public Hearing - <br /> <br />03 - 344 - Public hearing on certain general obligation financing of the City in the <br />estimated maximum amount of $5,450,000 to finance, in whole or in part, the cost of <br />certain redevelopment projects including the acquisition of property located in the <br />proposed new enterprise zone located in the area of Midtown and the demolition of <br />existing buildings located on such property. <br /> <br />1.
