September 9, 2003 <br /> <br /> At a Regular Meeting of the City Council <br />there were present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard <br /> <br />on Tuesday, September 9, 2003, <br /> <br />D. Griffin, Sr., Cameron C. Pitts, <br /> <br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. <br />Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br /> Councilman Cameron C. Pitts opened the meeting with prayer, which was <br />followed by the Pledge of Allegiance to the Flag, presented by Boy Scout Troop 233. <br /> <br /> Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br /> Mayor Holley introduced Curtis Walton, an intern with the City Manager's Office. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a <br />Called Meeting on August 25, 2003, a Called Meeting on August 26, 2003, and a <br />Regular Meeting on August 26, 2003, and was adopted by unanimous vote. <br /> <br />03 - 316 - Presentations: <br /> <br />· Special presentation of a proclamation to Floyd Twiford and Dabney Morgan for <br /> "Coleman's Nursery 60th Anniversary Celebration Month." <br /> <br />· Proclamation presented to Margaret Windley for "Constitution Week." <br /> <br />· Proclamation presented to Reverend Elise Murphy Woodard for "Reverend Elise <br /> Murphy Woodard Month." <br /> <br /> - Public Hearing - <br /> <br />03 - 317 - Public hearing on a proposed Enterprise Zone Application to the state, which <br />will encompass the Midtown and Victory Crossing areas of the City. <br /> <br />There were no speakers. <br /> <br />03 - 318 - Public hearing on use permit and rezoning applications: <br /> <br />(a) UP-03-18 SOUTHSlDE NEIGHBORHOOD - Andrew Constantinides requests <br /> a use permit to operate an adult book and novelty shop at 3209 <br /> George Washington Highway. The Comprehensive Plan <br /> recommends industrial development. <br /> <br />1. Robert Barclay, 200 High Street, Suite 500, spoke in support of this item. <br /> <br />2. Andrew Constantinides, 408 Charlotte Drive, spoke in support of this item. <br /> <br />3. Reggie Allen, 1421 Wilcox Avenue, spoke in opposition to this item. <br /> <br />4. Dave Levenson, 316 Kanawah Run, Yorktown, spoke in opposition to this item. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to concur with the <br />recommendation of the Planning Commission that UP-03-18 be denied on first and final <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Benn, Moody, Pitts, Randall, Whitehurst <br />Nays: Griffin, Holley <br /> <br /> <br />
