July 8, 2003 At a Regular Meeting of the City Council on Tuesday, July 8, 2003, there were present: Vice Mayor Bernard D. Griffin, Sr., J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. Councilwoman Marlene W. Randall opened the meeting with prayer, which was followed by the Pledge of Allegiance to the Flag. Vice Mayor Griffin called the meeting to order and welcomed all in attendance. Motion by Mr. Moody, and seconded by Ms. Randall, to approve the minutes of a Called Meeting on June 24, 2003, a Regular Meeting on June 24, 2003, and a Called Meeting on June 30, 2003, and was adopted by unanimous vote. - Public Hearing - 03 - 240 - Public hearing on use permit and rezoning applications: (a) UP-03-13 CHURCHLAND AND COMMERCIAL - Medina J. Doerr requests a use permit to operate an entertainment establishment at 5700 Churchland Boulevard, Suite 39. The Comprehensive Plan recommends commercial use. Motion by Mr. Benn, and seconded by Mr. Moody, to concur with the recommendation of the Planning Commission that UP-03-13 be approved on first reading, and was adopted by unanimous vote. (b) UP-03-14 DOWNTOWN NEIGHBORHOOD - Robyn Thomas, agent for Audrey Ling, requests a use permit to operate a 188-seat restaurant at 623 High Street. The Comprehensive Plan recommends commercial use. Motion by Mr. Whitehurst, and seconded by recommendation of the Planning Commission that reading, and was adopted by unanimous vote. Mr. Moody, to concur with the UP-03-14 be approved on first (c) Z-03-10 WESTBURY NEIGHBORHOOD - Greg Dodd requests to rezone 1201 thru 1315 County Street from multi-family residential, RM-60 to downtown, D-I-R. The Comprehensive Plan recommends medium-density residential development. Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the recommendation of the Planning Commission that Z-03-10 be approved on first reading, and was adopted by unanimous vote. - Unfinished Business - 03 - 194 - Adoption of an ordinance restricting the towing of vehicles from public-private parking garages. Deferred from the June 10, 2003 City Council meeting. Motion by Mr. Benn, and seconded by Mr. Whitehurst, to withdraw Item 03-194 from the agenda at the request of the City Manager, and was adopted by the following vote: Ayes: Benn, Griffin, Moody, Randall, Whitehurst Nays: None
