July 8, 2003 <br /> <br /> At a Regular Meeting of the City Council on Tuesday, July 8, 2003, <br />there were present: <br /> <br />Vice Mayor Bernard D. Griffin, Sr., J. Thomas Benn III, William E. Moody, Jr., Charles <br />B. Whitehurst, Sr., Marlene W. Randall, City Manager C. W. McCoy, City Attorney G. <br />Timothy Oksman. <br /> <br /> Councilwoman Marlene W. Randall opened the meeting with prayer, which was <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Vice Mayor Griffin called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Moody, and seconded by Ms. Randall, to approve the minutes of a <br />Called Meeting on June 24, 2003, a Regular Meeting on June 24, 2003, and a Called <br />Meeting on June 30, 2003, and was adopted by unanimous vote. <br /> <br />- Public Hearing - <br /> <br />03 - 240 - Public hearing on use permit and rezoning applications: <br /> <br />(a) UP-03-13 <br /> <br />CHURCHLAND AND COMMERCIAL - Medina J. Doerr requests a <br />use permit to operate an entertainment establishment at 5700 <br />Churchland Boulevard, Suite 39. The Comprehensive Plan <br />recommends commercial use. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Moody, to concur with the <br />recommendation of the Planning Commission that UP-03-13 be approved on first <br />reading, and was adopted by unanimous vote. <br /> <br />(b) UP-03-14 <br /> <br />DOWNTOWN NEIGHBORHOOD - Robyn Thomas, agent for <br />Audrey Ling, requests a use permit to operate a 188-seat <br />restaurant at 623 High Street. The Comprehensive Plan <br />recommends commercial use. <br /> <br /> Motion by Mr. Whitehurst, and seconded by <br />recommendation of the Planning Commission that <br />reading, and was adopted by unanimous vote. <br /> <br />Mr. Moody, to concur with the <br />UP-03-14 be approved on first <br /> <br />(c) Z-03-10 <br /> <br />WESTBURY NEIGHBORHOOD - Greg Dodd requests to rezone <br />1201 thru 1315 County Street from multi-family residential, RM-60 <br />to downtown, D-I-R. The Comprehensive Plan recommends <br />medium-density residential development. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the <br />recommendation of the Planning Commission that Z-03-10 be approved on first reading, <br />and was adopted by unanimous vote. <br /> <br />- Unfinished Business - <br /> <br />03 - 194 - Adoption of an ordinance restricting the towing of vehicles from public-private <br />parking garages. Deferred from the June 10, 2003 City Council meeting. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Whitehurst, to withdraw Item 03-194 <br />from the agenda at the request of the City Manager, and was adopted by the following <br />vote: <br /> <br />Ayes: Benn, Griffin, Moody, Randall, Whitehurst <br />Nays: None <br /> <br /> <br />
