June 10,2003 <br /> <br /> 2. That a group housing use permit for the construction of 58 residential <br />condominium units is hereby granted to the applicant subject to the following terms and <br />conditions: <br /> <br />(a) The group housing project shall be limited to 58 condominium units. <br /> <br /> (b) The applicant shall construct the 58 condominium units in accordance to the <br />floor plans, building materials (brick) as shown Exhibits A-1 through A-6 and B-1 <br />through B-10, adopted hereby and on file in the Department of Planning and Zoning. <br />All building construction is subject to review and approval by the River Pointe <br />Architectural Review Board. <br /> <br /> (c) A landscaping plan shall be developed and installed in accordance to Exhibit <br />C, attached hereto and made a part hereof. The Director of Planning and Zoning may <br />approve any minor modifications. <br /> <br /> (d) A lighting plan for the development must be approved by the Department of <br />Engineering prior to issuance of building permits. <br /> <br /> (e) The applicant shall be responsible for the cost and upgrading of utilities for <br />this development. The applicant shall coordinate the sewer line design with the Director <br />of Public Utilities. <br /> <br /> (f) Any revisions to the site plan, landscaping plan, or elevations made during <br />the group housing application process, including any changes made in response to City <br />Council conditions, must be submitted to the Director of Planning and Zoning for <br />approval prior to issuance of building permit. <br /> <br /> (g) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />necessary licenses and permits. <br /> <br /> (h) Trash services to the development shall be provided through a private <br />contractor. <br /> <br /> (i) All taxes and fees owed in connection with the property shall be paid when <br />due. <br /> <br /> (j) The development of the site shall comply with proffers of the underlying <br />zoning. <br /> <br /> 3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />Ayes: Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />03 - 194 - Adoption of an ordinance restricting the towing of vehicles from public-private <br />parking garages. Lawrence Fleder, 500 East Main Street, Norfolk, spoke in opposition to this item. <br /> <br />3. James Caplan, 500 East Main Street, Norfolk, spoke in opposition to this item. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to defer consideration of <br />03-194 for 30 days to the meeting of July 8, 2003, and was adopted by unanimous vote. <br /> <br /> <br />
