328 <br /> <br />April 11, 1994 <br /> <br />- UNFINISHED BUSINESS <br /> <br />93-428 Public Hearing on a code amendment: <br /> <br />{b) CA-93-04 <br /> <br />CODE AMENDMENT A proposed code amendment <br />changing the use permit requirements for adult <br />entertainment, theaters, bookstores, <br />nightclubs, and similar uses. Deferred from <br />the Public Hearing of February 7, 1994. <br /> <br />Frederick House, 20 Aylwin Crescent, spoke in favor of the <br />proposed code sanendment. <br /> <br />Nelson Fields, 3915 Turnpike Road, spoke in favor of the <br />proposed code amendment. <br /> <br />Andrew Constantinides, 5109 Garner Avenue, spoke on including <br />the grandfathering of his properties in the proposed code <br />amendment. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Griffin, to <br />concur with the recommendation of the Planning Commission, <br />CA-93-07 be approved. <br /> <br />that <br /> <br /> An amended motion by Mr. Pitts, and seconded by Mr. <br />Epperson, to change the word "emphasis" to "dominant theme", <br />and the original motion was adopted with the amended change by <br />unanimous vote. <br /> <br /> Motion by Mrs. Webb, and seconded by Mr. Epperson, to <br />approve the Adult Use guidelines including a guideline making <br />non-transferable any use permit for an adult use, and was <br />adopted by unanimous vote. <br /> <br />On motion meeting was adjourned at 8:15 p.m. <br /> <br />APPROVED <br /> <br />Vice Mayor <br /> <br />e~~la ~owell Pittman, CMC/AAE <br /> City Clerk <br /> <br />*Mayor Webb arrived at 7:18 p.m. <br /> <br /> <br />
