-- 327 April 11, 1994 At the Public Hearing Meeting of the City Council held on Monday, April 11, 1994, there were present: *Mayor Gloria O. Webb, Vice Mayor Lee E. King, Johnny M. Clemons, John H. Epperson, Bernard D. Griffin, James C. Hawks, Cameron C. Pitts, V. Wayne Orton, City Manager, Stuart H. Katz, City Attorney. Councilman Clemons opened the meeting with prayer which was followed by the Pledge of Allegiance to the Flag. The Vice Mayor called the meeting to order and welcomed all attendance. 94-110 Public Hearing on use permits and code amendment applications: (a) UP-94-03 WEST PARK VIEW NEIGHBORHOOD - Use permit application of Pamela J. McCain for a residential adult care facility at 1733 Mathew Terrace. Motion by Mr. Hawks, and seconded by Mr. Pitts, to concur with the recommendation of the Planning Commission, that UP-94-03 be denied, and was approved by the following vote: Ayes: Epperson, Griffin, Hawks, King, Pitts Nays: Clemons (b) UP-94-05 MOUNT HERMON NEIGHBORHOOD - Use permit application of The STOP Organization & Head Start Program for a day care center at 2680 High Street. Motion by Mr. Griffin, and seconded by Mr. Pitts, to concur with the recommendation of the Planning Commission that UP-94-05 be approved on first reading, and was approved by unanimous vote. (c) CA-94-07 CITY CODE AMENDMENT - A proposed code amendment to amend Chapter 33 of the Subdivision Ordinance relating to waiver of required improvements. Motion by Mr. Hawks, and seconded by Mr. Epperson, to concur with the recommendation of the Planning Commission that CA-94-07 be approved on first reading, and was approved by unanimous vote. (d) CA-94-09 CITY CODE AMENDMENT - A proposal to amend Section 40-162 of the Zoning Ordinance to repeal waivers allowed for non-conforming zone lots. Motion by Mr. Epperson, and seconded by Mr. Pitts, to concur with the recommendation of the Planning Commission that CA-94-09 be approved on first reading, and was approved by a vote of 6-1 (Griffin). Motion by Mr. Hawks, and seconded by Mr. Clemons, to authorize the Planning Director to have Portsmouth Redevelopment and Housing Authority proceed with the vacant lot Homestead Program, and was adopted by a vote of 6-0-1 (Mr. Griffin abstained due to his ownership of land affected by this action).
