April 22, 2003 03-130(a): "A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF A CHILDCARE CENTER AT 3204 VICTORY BOULEVARD. WHEREAS, Paula Glover has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a child care center (SIC 835) at 3204 Victory Boulevard, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended granting the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a child care center on property located at 2304 Victory Boulevard, and being more particularly described as: UP-03-08 Beginning at a point 640.06'_+ from the northeast corner of Victory Boulevard and Beazley Drive; thence in an easterly direction 60'_+ to a point; thence, in a northern direction 208.18'_+ to a point; thence, in a western direction 55.52'_+ to a point; thence, in a southern direction 208.18'_+ to a point of the beginning. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The center shall comply with the submitted site plan and floor plan. (b) The age of the children shall be from newborn to 2 ½ years. (c) time. No more than twenty-two (22) infants may occupy the center at any one (d) The days and hours of operation shall be from 6:00 a.m. until 10:00 p.m., Monday through Saturday.
