April 22, 2003 BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to execute a Deed of Release and such other documents as may be necessary to release an easement for a water line on property located at the southeast intersection of North Main Street and East Constance Road in the City of Suffolk which is being developed by the Industrial Development Authority of the City of Suffolk." Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley Nays: None 03 - 156 - Adoption of a resolution authorizing the City Manager to execute a deed of easement to Dominion Virginia Power for the purpose of providing power to facilities at the Hoffler Creek Wildlife Preserve. Recommendation: · Adoption of a resolution authorizing the City Manager to execute a deed of easement to Dominion Virginia Power for the purpose of providing power to facilities at the Heftier Creek Wildlife Preserve. Purpose and Need: · Lines were installed last year by Dominion Virginia Power to provide power to facilities on the site. · The lines were placed immediately adjacent to the roadway as to avoid as little damage to the Preserve as possible. Financial Impact: · The cost of installing this line has been paid by the Foundation. Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following resolution, and was adopted by the following vote: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO GRANT A RIGHT-OF- WAY AGREEMENT TO VIRGINIA ELECTRIC AND POWER COMPANY DOING BUSINESS AS DOMINION VIRGINIA POWER FOR ELECTRIC POWER ACROSS HOFFLER CREEK WILDLIFE PRESERVE. BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to grant and convey to Dominion Virginia Power an easement as follows: An easement of 20 feet in width and 50 feet in length along the west side of Twin Pines Road, and 20 feet in width and 250 feet in length in a westerly direction from the west side of Twin Pines Road for the purpose of installing and maintaining underground cables and conduits for the distribution of electric power to that property of the City of Portsmouth known as the Heftier Creek Wildlife Preserve, all as shown on that certain plat prepared by Virginia Electric and Power Company numbered as Virginia Electric and Power Company Right of Way Agreement Number 26-01- 0063. BE IT FURTHER RESOLVED that the City manager grant such easement under such terms as he deems appropriate and in the best interest of the City of Portsmouth."
