April 22, 2003 Purpose and Need: · These legal fees are the result of existing costs for services and for those anticipated until June 30, 2003. · The only source for funding this appropriation is the City's Undesignated Fund Balance. Financial Impact: · The City's Undesignated Fund Balance will be reduced by $200,000. Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE TO APPROPRIATE $200,000 IN THE GENERAL FUND FOR LEGAL FEES." Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley Nays: None 03 - 155 - Adoption of a resolution authorizing the City Manager to execute a deed of release for an easement to the City of Suffolk and such other documents or plats as may be necessary to release an easement for water lines on the property to be developed as a hotel site at the intersection of North Main Street and East Constance Drive in the City of Suffolk. In order for the City of Suffolk to develop this site for a new hotel, it is necessary to release the easement, which is no longer required by the City of Portsmouth for its water lines. Recommendation: · Adoption of a resolution authorizing the City Manager to execute a deed of release for an easement to the City of Suffolk and such other documents or plats as may be necessary to release an easement for water lines on the property to be developed as a hotel site at the intersection of North Main Street and East Constance Drive in the City of Suffolk. Purpose and Need: · In order for the City of Suffolk to develop this site for a new hotel, it is necessary to release the easement that is no longer required by the City of Portsmouth for its water lines. · The property is located at the southeast intersection of North Main Street and East Constance Road in the City of Suffolk as shown on the plat recorded in the Clerk's Office of the Circuit Court of the City of Suffolk in Plat Book 29, page 47. Financial Impact: · There will be no financial impact as a result of this release. Motion by Mr. Moody, and seconded by Ms. Randall, to adopt the following resolution, and was adopted by the following vote: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF RELEASE TO RELEASE AN EASEMENT ON PROPERTY LOCATED AT THE SOUTHEAST INTERSECTION OF NORTH MAIN STREET AND EAST CONSTANCE ROAD IN THE CITY OF SUFFOLK WHICH IS BEING DEVELOPED BY THE INDUSTRIAL DEVELOPMENT AUTHORITY OF THE CITY OF SUFFOLK.
