That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br /> (a) The site layout and landscaping shall be in accordance with Exhibit A. <br />Modifications shall made with the approval of the Planning Director prior to obtaining <br />building permits. <br /> <br /> (b) A 24-hour security lighting system for perimeter and interior of property <br />shall to be developed, installed and maintained. <br /> <br /> (c) Fourteen (14) parking spaces shall be provided for customers and <br />employees. The parking plan shall be developed in general accordance with Exhibit A, <br />attached hereto and made a part hereof. The plan shall be modified to comply with <br />Americans with Disabilities Act standards. Customers and employee parking spaces <br />shall be clearly marked. <br /> <br /> (d) The hours of operation shall be limited to 8 A.M. to 9 P.M. Monday <br />through Saturday. <br /> <br /> (e) A commercial re-inspection must be obtained prior to application for an <br />occupancy permit. <br /> <br /> (f) The facility shall be developed and operated in accordance with all <br />local, state and federal laws and requirements. <br /> <br /> (g) All taxes, in connection with the property and the proposed operation <br />shall be paid when due. <br /> <br /> (h) The City may to inspect the facility to ensure that all use permit conditions <br />are being met. <br /> <br /> (i) There shall be no storage of wrecked vehicles on site. No open storage of <br />tires shall be permitted. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />03 - 105 -Adoption of an ordinance to appropriate $134,780 in the Grants Fund for the <br />construction of a Fire Training Burn Building and Fire Protection Equipment. <br /> <br />The Virginia Department of Fire Programs has approved the Fiscal Year 2003 <br />Fire Program Funds allocation for Portsmouth. There is no local match. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to appropriate $134,780 in the Grants Fund for the <br />construction of a Fire Training Burn Building and Fire Protection Equipment. <br /> <br />Purpose and Need: <br /> <br />· The Virginia Department of Fire Programs has approved the Fiscal Year 2003 Fire <br />Program Funds allocation of $134,780. <br /> <br />· This allocation will be used for purchasing firefighting equipment in the amount of <br />$34,780 and will assist in the improved training of firefighters by utilizing $100,000 <br />toward the cost of construction of a Fire Training Burn Building. <br /> <br /> <br />
