Februar~ 25, 2003 <br /> <br /> (h) The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />necessary licenses and permits <br /> <br /> (i) <br />contractor. <br /> <br />Trash services to the development shall be provided through a private <br /> <br /> (j) All taxes and fees owed in connection with the property and operation <br />shall be paid when due. <br /> <br />(k) No building shall exceed a maximum height of 55 feet. <br /> <br /> (I) Any variance to the setback requirements must be approved through the <br />Board of Zoning Appeals. <br /> <br /> 3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />03 - 69 - Adoption of an ordinance to amend Chapter 2 of the Code of the City of <br />Portsmouth adding Article 29 containing sections 2-822, 2-823 and 2-284 setting forth <br />membership and responsibilities of the Craney Island Study Commission. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to amend Chapter 2 of the Code of the City of Portsmouth <br />adding Article 29 containing sections 2-822, 2-823 and 2-824 setting forth membership <br />and responsibilities of the Craney Island Study Commission. <br /> <br />Purpose and Need: <br /> <br />· The Craney Island Study Commission currently exists pursuant to an ordinance that <br />is not part of the City Code and thus is not readily accessible to the public. Its <br />membership is limited to residents of Portsmouth. It is not charged with safeguarding <br />community quality in adjacent neighborhoods. <br /> <br />· This action would make the membership and responsibilities of the Commission <br />more accessible to the public by placing the Commission in the City Code, would give <br />the Commission enhanced official status, and would increase its membership by adding <br />the City Manager and three Suffolk residents. Existing Commission members would be <br />continued in office. <br /> <br />· The responsibilities of the Commission would be broadened to include considering <br />the effect of Craney Island on adjacent neighborhoods in Portsmouth and Suffolk. <br /> <br />· The Commission would be required to make an annual report to City Council. <br /> <br />Financial Impact: <br /> <br />There is no financial impact. <br /> <br /> <br />
