November 26, 2002 <br /> <br /> (d) The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />necessary licenses and permits. <br /> <br /> (e) All taxes in connection with the subject property or the proposed operation <br />shall be paid when due. <br /> <br /> (f) The applicant shall not violate any laws of the Commonwealth or <br />ordinances of the City related to peace and good order, nor suffer any such violations <br />by its patrons or customers. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />02-339(d): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO SHELIA POISSON FOR THE <br />OPERATION OF A FAMILY DAY CARE HOME FACILITY AT 9 SHOAL COURT. <br /> <br /> WHEREAS, Shelia Poisson has made application pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to <br />operate a family day care home facility at 9 Shoal Court, Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting the <br />application for a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Shelia Poisson is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a <br />family day care home facility on property located at 9 Shoal Court, and being more <br />particularly described as: <br /> <br />UP-02-22 <br /> <br /> Beginning at a point approximately 413' from the <br />southeast corner of the intersection of Shoal Court and Long <br />Point Boulevard; thence in a easterly direction approximately <br />63' to a point; thence in a southerly direction approximately <br />145' to a point; thence in an easterly direction approximately <br />75' to a point; thence continuing in an easterly direction <br />approximately 29' to a point; thence in a northerly direction <br />approximately 114' to the point of beginning. <br /> <br /> <br />
