November 12, 2002 Motion by Mr. Moody, and seconded by Mr. Whitehurst, that agenda item Z-02-05 be denied, and was denied by the following vote: Ayes: Benn, Moody, Pitts, Randall, Whitehurst Nays: Griffin, Holley (b) UP-02-15 DOWNTOWN NEIGHBORHOOD - Isaac Williams requests a use permit to convert a restaurant into an entertainment establishment at 623 High Street. The Comprehensive Plan recommends commercial use. Motion by Mr. Whitehurst, and seconded by Mr. Moody, to refer this item back to the Planning Commission and that it not to be returned to Council's agenda until all taxes are current, all other matters related to the use permit are in order, and was adopted by the following vote: Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley Nays: None (c) UP-02-20 VICTORY CROSSING - Edgar Pinilla requests a use permit to operate a 131 seat Mexican restaurant with the sale of alcoholic beverages at 4020 Victory Boulevard. The property is zoned General Commercial, C-2. The Comprehensive Plan recommends commercial development. Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the recommendation of the Planning Commission that UP-02-20 be approved on first reading, and was adopted by unanimous vote. (d) UP-02-22 LONG POINT NEIGHBORHOOD - Shelia Poisson requests a use permit to operate a family daycare for eight (8) children at 9 Shoal Court. The Comprehensive Plan recommends single-family residential uses in this area. 1. Shelia Poisson, 9 Shoal Court, spoke in support of this item and asked about the City's requirement that no one outside of the home be employed in the operation. Motion by Mr. Benn, and seconded by Mr. Moody, to concur with the recommendation of the Planning Commission that UP-02-22 be approved on first reading, and was adopted by unanimous vote. (e) SNC-02-02 WESTHAVEN NEIGHBORHOOD - Ordinance granting the request of the City of Portsmouth for a street name change of the existing Bart Street to Gloria Carr Drive. The existing street is located between South Street and the completed Bart Street, between Airline and Frederick Boulevards. Motion by Mr. Pitts, and seconded by Mr. Moody, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE TO CHANGE THE NAME OF BART STREET TO GLORIA CARR DRIVE BETWEEN SOUTH STREET AND THE COMPLETED BART STREET, BETWEEN AIRLINE AND FREDERICK BOULEVARDS." Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley Nays: None
