RcP <br /> <br />Narch 9, 1909. <br /> <br /> 'From this order a suspension of sixty days was atowed ~o as to~all0w Norfolk 0ounty time to <br /> present its petition for an appeal to th~ Supreme-Oour.t of Appeals of Firgi~ia. <br /> <br /> "t now have the further honor and pleasure_of informing you that the said petition for appeal <br /> was denied and the territory embraced in said order is now, and has been since November 2t, 1908, <br /> a part of the City of Portsmouth. <br /> <br /> "This territory then, as described in said order, being now a part of the Oity of~Portsmouth <br /> it is imperative that you should take immediate steps to carry into effect the terms,.provisions <br /> and conditions of said order; all of which you will find fully Set forth in the opinion of the <br /> Court in section six (6), page six (6} of said order; and in section seven (?), page seven (7) of <br /> said order. <br /> <br /> 'The First and most important of these, and requiring i~ediate attention, is clause six (6}, <br />page seven (?) as to Fire and Police protection. That clause provides: "The 0ity of Portsmouth <br />shall furnish fire protection to the ~nnexed territory which shall include not less.thtn two <br />bination chemical.and hose wagons, and shall provide sc many policemen for said territory as the <br />Board of Police 0o~mmissioners of the 0ity may .deem necessary, not less, however, than six. <br /> <br /> "As this territory is now without Police and ~re protection,-the constables and special po- <br />lice of Norfolk 0ounty being now without authority, I ~ecommend that you at once authorize the Nay- <br />or to appoint the additional policemen until provision by ordinance ~ be m~de for the same; and <br />that by resolution you authorize and direct the Ohief of the Fire Depart~ment to furnish fire pro- <br />tection to this territory; and that you t~ke immediate steps to provide the additional combination <br />chemical hose wagons for the ~ame. <br /> <br /> "Under the provisions of section seven (7), page seven (?~ of said order you are required to <br />pay ~o Norfolk County the territory,s proportion of the existing debt of Norfolk Oounty, specified <br />in said order as $1~980.00. I, therefore, recommend that you order a warrant for that sum to be <br />issued payable to Norfolk 0ounty. <br /> <br /> "You are further required by said ordSr, and apse by the <br /> <br />into wards and forthwith select councilmen therefor. <br /> <br /> 'Under the provisions of your ordinance you provided for two wards in said territory; the boun- <br />daries of the sam~ should be at once fixed by ordinance. You also provided for three councilmen <br />from each; two in the common branch and one in the select branch. <br /> <br /> "These and all other matters specially recommended h~reln deserve and should receive your im- <br /> <br />mediate attention. <br /> "Respectfully, <br /> Jno. W. Eapper, Oity Attorney." <br /> <br /> The communications from the 0ity Attorney having been read Mr. Welton movedthat the Joint <br />Public Property Committee be instructed to prepare and bring in plans and specifications for a <br />clerk's office. The motion was adopted. <br /> <br /> Nr. Watts stated that the Nayor had requested the appointment immediately of six policemen <br />for the new territory and also that the full capacity of the ~ire Department be extended to the <br />same. He therefore moved that the recommendations of the 0ityAttorne~ in regard to the police <br />and fire protection for the new territory be now adopted, and that his other recommendations be <br /> <br />referred to the proper committees. <br /> <br /> Mr. Welton moved te amend, that an appropriation <br />co~ection-with the police service in said territory. <br /> <br /> Mr. Brinson moved to further amend, that the six <br />theBoard of Police Commissioners. <br /> <br /> Then the motion of Mr. Watts. as amended by N~r~ <br /> <br />statute, to organize the new territory <br /> <br />of $50 be made for horse hire to be used in <br /> <br />additional policemen shall be appointed by <br /> <br /> <br />
