The lessee is to enter into bond in the penalty o~ $100,000, payable to the Ooun- <br /> d <br /> ty of Norfolk and City of For~smouth, with a good an~suffiolen~ security to be approved by the Gom- <br /> mitoses on Finance of the Board of supervisors of Norfolk Oounty and the 0ouncii of the City of <br /> ~ortsmouth, conditioned for the faithful performance of all the conditions of the lease, and said <br /> lessee shall also at the same time the said eontrac? is executed deposit in one or more bsmks in <br /> the cities of Norfolk or Bortsmeuth an aggregate sum of not less than ~5,000 to be expended on such <br /> improvements, alteratiens and betterments on the ferry propertyas may from time to time be agreed <br /> upon between ~he Ferry oommittees of the said city and county and the said lessee, payment out of <br /> said f~nds only to be made by the check of the lessee, to which shall be attached the certificate <br /> of the chairman of the ~e~ry ~ommittees ~f the council of the City of ~ortsmouth and Board of ~uper~ <br /> visors of'Norfolk County, certifying that the amount of said check was expended for betterments or <br /> improvements to Ferry property, by and with the consent of the ~erry Committee of the said 0ity and <br /> County. and the lessee shall forthwith depo~sit a~sum equal to that drawn bY said check so as to have <br /> on deposit a~ al~ times the sum of ~5,000 for said improvements. <br /> ELEVENTE. For failmre to run a Dear cn schedule time the lessee shall forfeit the <br /> sum of ~5.00 a trip, one-half to the 0ity a~d cne-hmlf to ~he Oount~, unless said failur~ is due <br /> to an act of ~rovidenoe or to some unavoidable occurrence which could not be foreseen or prevented <br /> <br />by the lessee. TWELFTH. Loads ef vehicles are to be limited to six thousand pounds in weight. <br /> <br /> THIRTEENTH. The approaches-to the ferry boats are to be k~pt as clean as practicable, <br />,and boats and wai~ing rooms are to be well lighted, heated, ventilated and tidy, to satisfaction of <br />the Joint Ferry Committee of the Oi~y and ~ounty'; and any failure to observe the conditions of this <br />sectionshall subject the lessee to a fineof ~5.0~ (one-half of the fine to ge to the City and one~ <br />half to the 0ounty~, after a ten d~ys notice of s~id failure to the lessee or manager of the <br />ties by said 0ommittee. <br /> FOURTEENTH.~ No boat shall be purchased by the lessee for the use of ~the Ferries <br /> where the expenditure exceeds ~5,000, and no fer~yhomse shall be built by the lessee for the use of <br /> the Fe~ie~ where the exp~andi~u=e exceeds ~2,500, without the consent of the Joint Ferry Committee <br /> of the Oo~ncii of the ~ity of Portsmouth and the t~aard of Supervisors of the ~ounty; and should su~n <br /> expenditures be made ~y the lessee without first obtaining such consent, then the boats and houses <br /> so purchased and built shall not be inventoried andvalued under the Drovisio~s of the ~ourth 01sues <br /> of these conditions. <br /> FIFTEENTH. The lessee shall at all times provide boats of sufficient capacity~and <br /> of s~TTicient number to accommodate ~he traveling public~ <br /> SIXTEENTH~ The Committees reserve the right to reject ~ and all bids, and no bid <br /> shall be receiveduntil the person o~ ~ersons making the same shall have deposited a certified check <br /> for the sum of five thousand dollars, payable to the Treasurer of the county of Norfolk.and the Treas- <br /> urer of the Oity of Portsmouth, to be forfeited upon~is or their failure to comply with such bid <br /> or the terms of the lease, but to be returned to such bidder upon his bid being rejected, or upon <br /> his complya~ce with the terms of said le~se. <br /> AND ~EEREA~ R.
