February 27, 2001 <br /> <br /> 2. That a group housing use permit for 21 apartment units for the elderly is <br />hereby granted to the applicant, Regency Development Associates, subject to the <br />following terms and conditions: <br /> <br />(a) Tenants will be restricted to persons 62 years of age or older. <br /> <br /> (b) Development of the site will utilize the existing school structure and must <br />be in accordance to the approved site plan identified as Exhibit A, attached hereto and <br />made a part hereof. Any changes to this plan must be reviewed and approved by the <br />Department of Community Quality and Planning Services. <br /> <br />(c) The structure will contain no more than 21 apartments for the elderly. <br /> <br />(d) The minimum square footage of the apartments will be 750 square feet. <br /> <br /> (e) <br />properties. <br /> <br />All lighting of the parking lot must be directed away from the abutting <br /> <br />(f) A minimum of 27 on-site parking spaces will be provided. <br /> <br />(g) Prior to the rehabilitation of the structure, the site must be subdivided. <br /> <br /> (h) <br />of the City <br />extended by <br /> <br />If a building permit for the project has not been approved within one year <br />Council approval, the project approval will be deemed expired unless <br />City Council. <br /> <br /> (i) The applicant and any successor in interest shall comply with all <br />applicable statutes, ordinances and regulations of federal, state and local governments <br />and shall obtain and maintain in effect all required permits. <br /> <br />(j) All taxes in connection with the property shall be paid when due. <br /> <br /> 3. EXPIRATION OF PERMIT: Unless extended as provided under Section 40- <br />115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use permit <br />shall expire for any portion of the approved project for which building permits have not <br />been issued if the applicant fails to apply for all building permits for the entire project <br />within one year of the adoption of this resolution. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />01-49(c): <br /> <br />"A RESOLUTION AUTHORIZING A REDUCTION IN THE OFF-STREET PARKING <br />REQUIREMENTS FOR A HOUSING FOR THE ELDERLY APARTMENT PROJECT <br />AT 253 CONSTITUTION AVENUE. <br /> <br /> WHEREAS, the applicant, Regency Development Associates, proposes to <br />convert the former Shea Terrace Elementary School at 253 Constitution Avenue into 21 <br />apartments for the elderly; and <br /> <br /> WHEREAS, the applicant has requested that the required off-street parking be <br />reduced from 32 to 27 parking spaces, as permitted by Section 40-45.1 of the City <br />Code; and <br /> <br /> WHEREAS, satisfactory assurances have been provided to City Council that <br />such housing will be restricted only to individuals aged 62 or older; and that no units will <br />be occupied by persons without regard to age; and <br /> <br /> WHEREAS, in view of the location of the proposed project, the economic status <br />of the anticipated occupants and other pertinent considerations, a reduction in the <br />required number of off-street parking spaces will adequate off-street parking for <br />occupants and visitors. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that the off-street parking requirement for the subject project at <br />253 Constitution Avenue is hereby reduced from 32 spaces to 27. <br /> <br /> <br />
