<br />said Ward.

<br /> ~Gentlemen:--
<br /> ~Replying to a communication addressed to me, as City Attorney, by the City Clerk,
<br />which states:
<br /> 'The Sixth and Seventh Ward ~ocal Boards desire your opinion as to ~nether, in the paving of
<br />streets in said Wards, the Eorfolk and Portsmouth Traction Company can be compelled to provide for
<br />pavement between its tracks and two feet on each side of same, as it is required to do in the City
<br />proper.'
<br /> While this question is not free from doubt, I am constrained to resolve this doubt-in favor of
<br />the City, and answer in the affi.~mative.
<br />Under the Company's present contract with the City, Hay IT, 18~7, it agrees to pave South Street
<br />bet~ween its tracks and two feet on each side and any and all other streets that may be hereafter p~ved.
<br /> These streets are now, by annexation, streets of the City and the Company in ~aking its contract
<br />with the ~'~
<br /> ~wy. as I construe the decision in Wade vs, the City of Ri~h~ond, 18 Graft., 583, should
<br />have realized and understood that sometime, in the near future, the limits of the City would be
<br />tended.
<br /> Besides the improvement of these streets, while calling from the Company an immediate expendi-
<br />ture, necessarily increases its revenues, thereby Infl~oting no loss,
